ORDINANCE NO. 1788
AN ORDINANCE FOR EXCHANGE OF PROPERTY WITH GRAHAM
HOSPITAL FOR THE IMPROVEMENT ON WEST MAPLE STREET
WHEREAS, the City Council approved a plan for the re-location of West Maple
Street for the improvement of traffic and to improve access to the Graham Hospital; and,
WHEREAS, Graham Hospital has completed the construction of the re-location
of West Maple Street; and,
WHEREAS, the City of Canton has examined the re-location and the roads
construction there on and finds that they are satisfactorily completed and acceptable to
the City; and,
WHEREAS, Graham Hospital was responsible for all cost associated with the re-
location of West Maple Street; and,
WHEREAS, in consideration of the re-location of West Maple Street the City
and Graham agreed to exchange properties; and,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CANTON, Fulton County, Illinois, as follows:
1. The City agrees to accept West Maple Street as shown on a drawing dated
October 23, 2003 and designated project number 234-03070A. See
Attachment.
2. The City of Canton agrees to convey to Graham Hospital Association Old
West Maple Street as shown as Parcel A. (as shown on the above
described drawing)
3. In exchange Graham Hospital agrees to convey New West Maple Street to
the City of Canton.
4. That the Mayor and City Clerk are hereby authorized and directed to
execute a deed for Parcel A to Graham Hospital and shall deliver said
deed in exchange for a deed from Graham Hospital to the City of Canton
for parcel B.
5. That this Ordinance shall become effective immediately upon its passage
by the City Council of the City of Canton, Fulton County, Illinois, and
approval by the Mayor thereof.
PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular
meeting this 16th day of December , 20 03 , upon a roll call vote as follows:

QUIT-CLAIM DEED
THIS INDENTURE WITNESSETH, That The
Grantor,
CITY OF CANTON, an Illinois municipal
corporation, duly organized and existing under and
by virtue of the laws of the State of Illinois and duly
authorized to transact business in the State where the
following described real estate is located, for and in
consideration of One Dollar and other good and
valuable consideration, the receipt of which is
hereby acknowledged, and pursuant to authority
given by the Canton City Council CONVEYS AND
QUIT CLAIMS to: Graham Hospital Association a
non-for-profit corporation whose mailing address is
210 West Walnut, Canton, Illinois 61520, the
following described real estate to-wit:
A Part of the North Half of Section 34, Township 7 North, Range 4 East of the Fourth
Principal Meridian, Fulton County, Illinois.
Commencing at the Northeast Corner of the Northwest quarter of said Section 34; thence
bearing South O1 degrees 07 minutes 15 seconds East, a distance of 30.01 feet to the south
right-of--way of Walnut Street and the Point of Beginning of Parcel I of Graham Hospital
Association's property as described in Document Number 78-58663, recorded in Volume
842, Page 335 in the Fulton County Recorder's Office; thence along said south right-of-
way bearing North 89 degrees 56 minutes 39 seconds East, a distance of 168.80 feet to the
northwesterly right-of--way of Martin Avenue as described in said Document Number 78-
58663; thence along said northwesterly right-of--way bearing South 28 degrees 59 minutes
39 seconds West, a distance of 264.30 feet to the Southeast Corner of Graham Hospital
Association's property as described in said Document Number 78-58663 and the Point of
Beginning of the parcel to be described.
From said Point of beginning; thence continuing bearing South 28 degrees 59 minutes 39
seconds West, a distance of 107.33 feet to the north line of E. Johnson Addition; thence
along said north line bearing South 76 degrees 29 minutes 48 seconds West, a distance of
85.99 feet; thence bearing North 68 degrees 02 minutes 24 seconds West, a distance of
29.10 feet; thence 131.72 feet along a curve to the left, whose radius is 265.00 feet and
wlSose chord bears North 82 degrees 23 minutes 21 seconds West, a distance of 130.37
feet; thence bearing North 06 degrees 47 minutes 23 seconds, West, a distance of 1.13 feet
to said southerly line of said Graham Hospital Association's Property; thence along said
southerly line bearing North 83 degrees 02 minutes 39 seconds East, a distance of 123.06
feet; thence continuing .along said southerly line bearing North 67 degrees 39 minutes 39
seconds East, a distance of 183.60 feet to the Point of Beginning; containing 0.233 acres
more or less.
