HomeMy WebLinkAboutOrdinance #1783• 4 •. - ORDINANCE NO. 1783 AN ORDINANCE VACATING A PART OF AVENUE E WHEREAS, it appears the City Council of the City of Canton, Illinois, that 65 ILCS/5/11-91-1 provides impertinent part that whenever the Corporate authorities of any municipality in the State of Illinois determine that the public interest will be subserved by vacating any street or alley, or part thereof, within their jurisdiction and any incorporated area, that said municipality may vacate that street or alley, or part thereof, by ordinance; and WHEREAS, the Corporate authorities of the City of Canton, Fulton County, Illinois, have determined that the public interest will be subserved by vacating a portion of Avenue E, being 155 feet North and South by 9 feet East and West adjacent to and immediately to the West of Lot 11 in Block 12 in Bacock's Quality Hill Addition to the City of Canton, Fulton County, Illinois. WHEREAS, the portion of street described herein and the properties contiguous thereto are wholly within the jurisdiction and corporate limits of the City of Canton, Illinois, and; WHEREAS, the Corporate authorities of the City of Canton, Illinois, have determined that the relief to the public from further burden and responsibility of maintaining the portion of the street described herein constitutes a public use or public interest authorizing the vacation; and NOW THEREFORE, AND BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, FULTON COUNTY, ILLINOIS: That the City Council of the City of Canton, Fulton County, Illinois, hereby finds the foregoing recitals to be fact. 2. That the following street shall be vacated by the City: Part of Avenue E being more particularly described: Beginning at the Southwest corner of Lot Number11, Block 2 of Babcock's Quality Hill Addition to Canton, Illinois; thence northerly along the West line of said Lot 11 a distance of 155 feet to the Northwest corner of said Lot 11; thence westerly a distance of 9 feet to a point; thence southerly a distance of 155 feet to a point; thence easterly a distance of 9 feefi to the point of beginning all in accordance to the accompanying plat and lying in Canton and Fulton County in Illinois. 3. That the City Clerk of the City of Canton, Illinois, is hereby directed to cause a certified copy of this Ordinance to be filed with the office of the Fulton County Recorder of Deeds immediately upon the passage and approval of this Ordinance. 4. This Ordinance shall be full force and effect immediately upon his passage by three-fourths (3/4) majority vote of the alderman holding office in the City of ...
