Ordinance No. 17$2
Ordinance rezoning property of Artie Ellsworth at the address of East Locust
Street in the city of Canton, IL 61520, Fulton County, from R-3 to Ag-1.
Whereas, a petition was filed with the City Clerk for the rezoning of the real
property described below, and said property is within the corporate limits of the City of
Canton, Illinois.
Whereas, the current zoning of the subject premises is R-3 and it is the intention
of the owners that it be changed to a zoning of Ag-1.
Whereas, a public hearing on said petition was conducted by the Planning and
Zoning Commission of the City of Canton on October 13, 2003 pursuant to proper
notice having been published in the Canton Daily Ledger.
Whereas, on October 13, 2003 the Planning and Zoning Commission
recommended to the City Council that the real property described in the attached
exhibit hereto be rezoned inthe City of Canton pursuant to Division 13, Article 11, Act 5,
Chapter 65, Illinois Compiled Statutes, 1992 (65 ILCS 5/11-13-1 et seq);
Whereas, it is the best interest of the City of Canton, Illinois that said real
property be rezoned in the City of Canton.
Now, Therefore, Be It Ordained By The City Council Of The City Of Canton,
Fulton County, Illinois as follows:
1. That the Canton City Council hereby finds as facts the assertions set forth
above.
2. That the described real property be and is hereby rezoned as follows:
A part of the East Half of the South Half of the Southwest Quarter
of the Southeast Quarter of Section 26, Township 7 North, Range 4
East of the Fourth Principal Meridian, Fulton County, Illinois,
described as follows and bearings refer to the Illinois State Plane
Coordinate System, West Zone:
Commencing at the Southwest corner of said East Half;
thence along the South line of said East Half bearing North
89 degrees 34 minutes 46 seconds East, a distance of
242.67 feet to a point for the PLACE OF BEGINNING;
thence bearing North 0 degrees 41 minutes 22 seconds
East, a distance of 177.50 feet to an iron pin; thence bearing
South 89 degrees 34 minutes 46 seconds West, a distance
of 121.50 feet to an iron pin; thence bearing North 0

degrees 41 minutes 22 seconds East, a distance of 481.36
feet to an iron pin; thence bearing North 89 degrees 49
minutes 27 seconds East, a distance of 536.62 feet to an
iron pin at the Northeast corner of said East Half; thence
bearing South 0 degrees 35 minutes 53 seconds West, a
distance of 656.55 feet to the Southeast corner of said East
Half; thence bearing South 89 degrees 34 minutes 46
seconds West, a distance of 416.21 feet to the PLACE OF
BEGINNING containing 7.614 acres. Subject to the rights, if
any, of the public for roadway purposes along the South
side of the above described tract.
3. That the Zoning Administrator is directed to make the appropriate changes to
the zoning maps of the City of Canton to show this rezoning.
4. That Artie Ellsworth is directed to record with the Recorder of Deeds of Fulton
County and to file with the County Clerk of Fulton County a certified copy of this
ordinance.
5. That this Ordinance shall be in full force and effect upon its passage by the
City Council of the City of Canton and approval by its Mayor.
Passed by the City Council of the City of Canton, Fulton County, Illinois at a
regular meeting this 18th day of Novezi~ber 2003 upon a roll call votes as follows:
