ORDINANCE NO. ~A,
AN ORDINANCE AMENDING SECTION 3-3-14 AMUSEMENTS - COIN-
OPERATED AMUSEMENT MACHINES IN THE CITY OF CANTON
WHEREAS, the Legal and Ordinance Committee has determined that it is
necessary and in the best interest of the City of Canton to amend sections in the
Municipal Code; and,
WHEREAS, section 3-3-14 has not been reviewed in several years and due to the
increase of the administrative cost associated with these activities and the process to
regulate and the enforcement of such activities a fee increase shall be implemented; and,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CANTON, Fulton County, Illinois, as follows:
1. That the foregoing recitals are hereby found to be fact.
2. That section 3-3-14 of the Canton Municipal Code is hereby amended to read
as follows:
3-3-14: CURRENCY-OPERATED AMUSEMENT MACHINES:
(a) Definition: Acurrency-operated machine, within the meaning of this
chapter, shall be a machine, for amusement or otherwise, which
depends, for its operation and the fulfillment of its intended purpose,
upon a deposit or insertion into the machine itself of currency, whether
coin or bill, authorized as legal tender by the United States of America.
This definition shall not include those machines designated as Video
Gaming Machines as set forth in Section 3-3-14.1.
(b) License Required: Every person, firm or corporation, operating its
place of business or carrying on its activities at a location within the
temtorial limits of the City of Canton, Illinois, shall first obtain a
license for each machine operated or active at such location. The
annual license fee for each such machine shall be the sum of thirty-five
dollars ($35.00) payable annually in advance and no fee or portion
thereof shall be refunded. The license shall be displayed on each
machine at all times.
(c) Application for License: Before any license shall be granted under the
terms of this Section, the person seeking said license shall file with the
Clerk, an application showing the location where the currency-
operated machine for which license is sought will be placed. The
Mayor shall then grant said license, attested by the Clerk.
(d) Penalty: Any person convicted for a violation of any of the provisions
of this Section shall be punished by a fine of not less than fifty dollars
($50.00) nor more than one hundred dollars ($100.00). Each currency-
operated machine which is not licensed shall constitute a separate
offense.

3. That this Ordinance shall become effective immediately upon its passage by
the City Council of the City of Canton, Fulton County, Illinois, and approval
by the Mayor thereof.
PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular
meeting this 16th day of Sevtember , 2003, upon a roll call vote as follows:
