AN ORDINANCE ANNEXING AND RE-ZONING CERTAIN TERRITORY TO THE CITY OF
CANTON, FULTON COUNTY, ILLINOIS BELONGING TO MICHAEL W. PETERSON AND
LOCATED AT 617 WEST CHESTNUT STREET, CANTON, ILLINOIS.
WHEREAS, a Petition for Annexation and Re-Zoning, signed by the owner of record of the
territory hereinafter described, was filed before the Planning and Zoning Commission of the City of
Canton, Illinois, requesting that said territory be aruiexed to the City of Canton and re-zoned to an
R-2 (Single Family Residential District) zoning classification; and
WHEREAS, the territory which is the subject of this Petition is described below:
Fifty-Three and one-half (53- %z) feet off the West side of Lot Nine (9) in Block One (1) Homewood
Addition to the City of Canton, situated in the City of Canton, in Fulton Caunty, Illinois
-P.I.N. 09-08-28-408-019 {a Map showing the property is attached as Exhibit A).
WHEREAS, Michael W. Peterson is the owner of record of the territory to be annexed and re-
zoned and there are no other owners of record and there are no electors residing within the said
territory to be annexed and re-zoned other than, Michael W. Peterson; and
WHEREAS, the territory to be annexed and re-zoned is not within the corporate limits of any
municipality, but is contiguous to the City of Canton, Illinois; and
WHEREAS, the territory to be annexed and re-zoned is part of the Copperas Creek
Community Fire Protection District; and
WHEREAS, proper notice of the Petition for Annexation and Re-Zoning has been given to
the trustees of the Copperas Creek Community Fire Protection District as provided bylaw and an
affidavit that service of notice has been made as provided by law has been filed with the Fulton
County Recorder of Deeds; and
WHEREAS, all petitions, documents and other necessary legal requirements are in full
compliance with the statutes of the State of Illinois and the ordinances of the City of Canton, Illinois,
and proper notice of the filing of the Petition for Annexation and Re-Zoning was given as provided
by law; and
WHEREAS, a public hearing was held before the Planning and Zoning Commission of the
City of Canton, Illinois, on September 13, 2004, pursuant to proper notice published in the Canton
Daily Ledger, a secular newspaper having a general circulation in the City of Canton, County of
Fulton and State of Illinois; and
WHEREAS, on September 13, 2004, the Planning slid Zoning Commission of the City of
Canton, Illinois, recommended to the City Council of the City of Canton, Illinois that the territory
described above be annexed to the City of Canton, Illinois, in a zoning classification of R-2 (Single
Family Residential District}, pursuant to the provisions of 65 ILCS 5/7-1-8 of the Illinois Municipal
Code; and
WHEREAS, the territory to be annexed and re-zoned has been used for many years as a single
family residence, is well suited for continued use as a single family residence and should be annexed
to the City of Canton, Illinois, in an R-2 (Single Family Residential District) zoning classification;
and
WHEREAS, the highest and best use of the territory to be annexed and re-zoned is its present
use, i.e., single family residential purposes; and
WHEREAS, it is in the best interest of the City of Canton, Illinois, that said territory be
annexed to the City of Canton, Illinois, in an R-2 (Single Family Residential District), zoning
classification.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Canton, Illinois,
as follows:
1. That the City Council finds as facts the recitals hereinabove set forth.
2. That the territory described above be and it is hereby annexed to the City of Canton, Illinois.
3. That the described real property be and it is hereby zoned R-2, single family residential.
4. That the Zoning Administrator is directed to make the appropriate changes to the zoning maps
of the City of Canton to show this annexation and zoning.
5. That Michael W. Peterson is hereby directed to record with the Recorder of Deeds of Fulton
County, Illinois, and to file with the County Clerk of Fulton County, Illinois a certified copy
of this Ordinance together with an accurate map of the territory annexed.
6. That this Ordinance shall be in full force and effect upon its passage by the City Council of
the City of Canton, Illinois, and approval by its Mayor thereof.
PASSED by a majority vote of the City Council of the City of Canton, Lllinois, and APPROVED by
the Mayor thereof this 5th day of October , ?004, upon a roll call vote as
follows:
Ayes: Aldermen Sarff, Fi 11 i nghasa, Harn, Carl , Hartford, Reed, West.
Nays: None.
Absent: Al derman Mol 1 eck.
