WHEREAS, by authorization of the City Council of the City of Canton, Illinois, the Mayor of the City of Canton did enter into a contract with the CHICAGO, BURLINGTON & QUINCY RAILROAD COMPANY, on behalf of the City of Canton, whereby the City of Canton was granted the right to enter onto the premises of said railroad company for the purpose of constructing a sixteen-inch cast iron pipe encased in a steel pipe to be used for conveying of storm water through and under the railroad tracts at Fourth Avenue and Hickory Street in the City of Canton, and also for purpose of performing certain work in connection with the spur track running into the property of the Phillips Petroleum Company, at said location; designated as Track 25; AND, WHEREAS, the said spur track has been taken care of and the question of repairing the tracks of the said railroad company at said Hickory Street has not been accomplished; AND, WHEREAS, Crawford, Murphy & Tilly, Consulting Engin- eers for the City of Cantons in the project number 63-A, have entered into a tentative agreement with said railroad company, subject to the approval of the City Council of the City of Canton, Illinois, whereby the said Chicago, Burlington & Quincy Railroad Company will improve the said railroad crossing on Hickory Street and Fourth Avenue for the amount of Five Hundred Dollars 0500.00); AND WHEREAS, said Crawford, Murphy & Tilly, Consulting Engineers as aforesaid, recommends that said agreement be entered for the constructing of said improvement at said location by said railroad company for X500.00, and further recommend that for the sake of expediency that said sum of money be paid out of the general fund of the City of Canton; THEREFORE, TT TS RESOLVED that the Mayor of the City of Canton b® and he is hereby authorized to enter into an agreement with the Chicago, Burlington and Quincy Railroad Company whereby said railroad company will do the work and carry on the construc- tion of repairing the tracks of the said railroad company at Fourth Avenue and Hickory Street, in the City of Canton, in accordance with the plans of Crawford, Murphy & Tilly for said Project 63-A, as heretofore prepared, and pay the said railroad not to exceed Five Hundred Dollars out of the general fund of the City of Canton for said work. AND TT IS FURTHER RESOLVED, that the proposed agreement under date of November 2, 1962, be and the same is declared void and abandoned by the said railroad company and said City of Canton, Illinois.
