HomeMy WebLinkAboutOrdinance #1797i ORDINANCE NO. 1797 AN ORDINANCE AMENDING TITLE 9, CHAPTER 3 SECTION 24 OF THE CANTON MUNICIPAL CODE REGARDING SKATEBOARDS AND ROLLER SKATES. WHEREAS, the Legal and Ordinance Committee has determined that it is necessary and in the best interest of the City of Canton to establish regulations and enforcement of such regulations in the City of Canton; and, WHEREAS, due to the increase of skateboarding and roller skating activities within the City of Canton enacting regulations and enforcement of such regulations shall be implemented; and, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. That the foregoing recitals aze hereby found to be fact. 2. That the following sections be added in the Canton Municipal Code to establish regulations and enforcement of such regulations as follows: 9-3-24.2 IMPOUNDMENT: The chief of police is hereby authorized and empowered to impound, for a period not to exceed sixty (50) days, any toy vehicle as defined in Section 9-3-24 or any skateboazd or roller skates used in violation of any of the provisions of this article or in violation of any of the ordinances of the city regulating traffic, so faz as they are applicable. When the owner/rider of any toy vehicle, skateboard or roller skates is known, he or she shall be given or sent a letter to his or her last known address notifying him or her that the toy vehicle, skateboard or roller skates have been impounded and informing the owner/rider how to claim the impounded toy vehicle, skateboard or roller skates. Where the owner/rider of the toy vehicle, skateboazd or roller skates is under age 17, a copy of the letter shall be sent to his or her pazent or guazdian, if known. Any toy vehicle, skateboazd or roller skates impounded under this Section may be redeemed after thirty (30) days or after the owner's first appearance in City Court, whichever occurs first. The redemption fee for any impounded property shall be twenty {$20.00) dollars. This fee is in addition to any fines or penalties, which may be assessed for the violation of the Canton City Code. After sixty (b0) days, all unclaimed toy vehicles, skateboards or roller skates shall be deemed property of the City of Canton. The following section of the Canton City Code shall read as follows: 9-3-24.3 PARENTAL RESPONSIBILITY: The parent of any minor child, and the guardian of any ward, shall not authorize or knowingly permit such child or ward to violate any of the provisions of this article. In the case of any violations of this article by a minor child or ward under the age of 13, any parent or guardian of such child or ward shall be presumed to be knowingly permitting the child or ward to violate the provisions of this article and shall be held financially responsible for any citations issued to the child. The following section of the Canton City Code shall read as follows: 9-3-24.4 PENALTY: Any person violating Section 9-3-24 or Section 9-3-24.1 of this Chapter or any person deemed responsible for any person violation said sections under Section 9-3-24.3 of this Chapter shall be fined not less than twenty five ($25.00) dollars nor more than five hundred ($500.00) 3. That this Ordinance shall become effective immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois, and approval by the Mayor thereof.
