ORDINANCE NO. 1790
AN ORDINANCE AMENDING 5-2-12, 5-6-4, 5-6-5 AND 5-1-2(.n OF THE
CANTON MUNICIPAL CODE RELATING TO FIRE CODES.
WHEREAS, the Legal and Ordinance Committee has determined that it is
necessary and in the best interest of the City of Canton to amend 5-2-12, 5-6-4, 5-6-5 and
5-1-2(~ of the Canton Municipal Code; and,
WHEREAS, the Canton City Council has made a similar determination.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CANTON, Fulton County, Illinois, as follows:
1. That the foregoing recitals are hereby found to be fact.
2. That accordingly, Titles 5-2-12, 5-6-4, 5-6-5 and 5-1-2(~ of the Canton
Municipal Code is hereby amended to read as follows:
5-2-12: 2000 INTERNATIONAL FIRE CODE APPLICATION: The city
reemphasizes those provisions of the 2000 international fire code
pertaining to installation of combustion devices and other
instrumentalities capable of initiating combustion by contact. The
city has previously adopted the 2000 international fire code. The
city anticipates that it may adopt later supplements to the fire code
as they become available and intends that all supplements later
adopted shall have the same force and effect of the 2000
international fire code upon their adoption by the city. Upon
adoption by the city, the provisions of anv later supplements to the
fire code shall be included in anv reference made to "the code."
The fire department shall have the authority to enforce the 2000
international fire code. The fire chief or his designees shall have the
authority to issue a citation to the owner, operator, occupant or
other person responsible for the condition which constitutes a
violation of said code. Further, storage of combustible or
flammable material shall be in accordance with said code. Any
person violating any 2000 international fire code provisions of this
nature shall be fined not less than seventy five ($75.00) dollars nor
more than five hundred ($500.00) dollars.
5-6-4 ENFORCEMENT: The provisions of this Section shall be enforced
by the police chief, the fire chief or the zoning administrator (as
defined in Section 10-17-2 of this Code) or their designees. The
fire chief or the zoning administrator or their designees shall have
the power to issue citations, notices to appear, sign complaints and
do all other acts and deeds reasonably necessary to effectuate the
requirements of this chapter subject to Section 6-1-2(K) of this
Code. The police chief or his or her designee shall have all powers
granted to them by state statutes and the provisions of the Code.
Whenever the police chief, fire chief or the code enforcement officer
or their designees have personal knowledge or probable cause to
believe that a violation of Ordinance 5-6-1 et. seq. has occurred, he
or she shall issue a citation to the owner, operator, occupant or
other person responsible for the condition or violation, either by
personal service, mail or by delivering the same to, and leaving it
with, some person of responsibility upon the premises. For
unattended or abandoned locations, a copy of such notice of
violation shall be posted on the premises in a conspicuous place at
or near the entrance to such premises and the notice of violation
shall be mailed by certified mail with return receipt requested or a
certificate of mailing, to the last known address of the owner, the
occupant or both.
5-6-5 PENALTY: Any person violating Section 5-6-1 or who fail to comply
with any requirement thereof shall be fined not less than seventy
five ($75.00) dollars nor more than five hundred ($500.00) dollars
for each offense. Each day that a violation continues after due
notice has been served shall be deemed a separate offense.
5-1-2(J) Enforcement: It shall be the duty of said Chief of the Fire
Department to cause all provisions of this Code for the prevention
of fires, and statutes, and all other regulations in reference to the
Fire Department, to be strictly enforced. The fire chief or his
designees shall have the power to issue citations, notices to
appear sign complaints and do all other acts and deeds reasonably
necessary to effectuate the requirements of Title 5 of the City of
Canton Code subject to Section 6-1-2(K) of this Code.
3. That this Ordinance shall become effective immediately upon its passage by
the City Council of the City of Canton, Fulton County, Illinois, and approval
by the Mayor thereof.

meeting this 2nd day of March , 20 04 , upon a roll call vote as follows:
