HomeMy WebLinkAboutResolution #3672s RESOLUTION NO. 3672 A RESOLUTION FOR THE SALE OF REAL ESTATE KNOWN AS THE OLD CITY BUILDING PURSUANT TO 65ILCS 5/11-76-4.2 WHEREAS, the City of Canton is a municipality with a population of less than 20,000 and an unemployment rate, as determined by the Illinois Department of Employment Security, higher than the national unemployment average, as one month during the 6 months preceding the adoption of a resolution to sell real estate under this Section; and, WHEREAS, the City of Canton has adopted a Resolution to sell surplus real estate on August 27, 2003 under Section 11-76-4.1 and has received no acceptable offer on a particular parcel within 6 months after adoption of the resolution, then that parcel of surplus real estate may be sold. Bids were twice submitted and determined unacceptable; and, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois as follows: 1. Authorize the sale of the Old City Building by staff. All inquires shall be referred to Clif O'Brien, Public Works Director; George Spahn, Street Superintendent or Clark Wilson, Zoning Officer. 2. The real estate shall be made available for sale to all local licensed realtors in the City of Canton. No real estate firm shall receive a commission as the listing real estate agent and listing shall be open to all realtors in the City of Canton. A 7% commission shall be paid to the selling agency or realtor. All offers shall be presented through the managing agent or licensed broker to the Public Works Director and the Chairman of Lake, Buildmgs and Grounds Committee for review to determine if offer is appropriate for Council consideration. 3. The terms of the sell shall be as follows: a Cash sale b Any sale shall be subject to a 3/o vote by the Corporate Authorities determined by the City to be in the best interest of the Municipality c Legal Description as Lots 2 & 3 in Barnes and Jones Addition to the City of Canton. d The site is a rectangular tract of land with frontage along East Chestnut Street a distance of 99 feet and a depth of 132 feet. e The site is zoned B-2, General Business. f The Resolution for the sell shall be published once each week for 3 successive weeks in a daily paper in the City of Canton. g No sale may be conducted until at least 30 days after the first publication. 4. That the City will require a plan to be submitted for the use of the property and any plan for remodeling or reconstruction of the interior or exterior. The sale will be subject to covenants restricting the demolition or the altering of the North, East or West exterior walls of the structure. ~` - z 5. That this Resolution shall be in full force and in effect immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois and approval by the Mayor thereof.
