RES OLUTION ~~`~~
WHEREAS, a Petition has been filed requesting the rezoning
of the realty hereinafter described and recommendations touching
thereon have been made to the City Council of the City of Canton,
Illinois after noticeeand hearing; and,
WHEREAS", it appears to the City Council that a special
use permit would authorize and enable utilization of said realty
as in said Petition prayed without the necessity of rezoning thereof,
NOW, THEREFORE, BE IT AND IT HEREBY IS RESOLVED BY THE
CITY COUNCIL OF THE CITY OF CANTON, ILLINOIS, AS FOLLOWS:
SECTION 1. That the realty described as follows:
Part of Lots 121 and 122 in Swans' Second Addition
to the City of Canton, Illinois, described as follows:
Beginning at the Northwest corner of Lot 121, thence
East 51 feet, 6 inches; thence South 149 feet, 4 1/2
inches; thence West 55 feet; thence North 149 feet,
4 1/2 inches to the point of beginning, situated in
the County of Fulton and State of Illinois.
which laid realty is located at the address d 136 East Spruce St.,
Canton,`Illinois, may be utilized for the operation of a bait, .
tackle and sporting goods shop by the Petitioner Martin Montgomery
and so long as said Petitioner himself. operates his bait, tackle
and sporting goods shop at said address but not thereafter.
SECTION 2,. That this Resolution shall constitute a special
use permit and not a re-zoning of said realty.
SECTION 3. That the City Clerk shall cause a certified
copy of this Resolution to be recorded in the Fulton County, Illinois
Land Records.
SECTION 4. That this Resolution shall be in full force
and effect upon and from 'its passage.
PASSED BY THE CITY OUNCIL OF THE CITY OF CANTON, ILLINOIS
