I further certify that on FEBRUARY 20, 2024, the City Council of such municipality passed and approved Ordinance #4395 entitled: AN ORDINANCE RESCINDING TITLE 3, CHAPTER 5 OF THE CANTON MUNICIPAL CODE REGARDING BILLBOARDS; POSTERS The ordinance attached is a true and correct copy of the ordinance adopted by Canton City Council. DATED AT CANTON, ILLINOIS, THIS 20TH DAY OF FEBRUARY, 2024 Seal- ndi Smith-Walters, City Clerk ity of Canton, Illinois ORDINANCE NO. 4395 AN ORDINANCE RESCINDING TITLE 3, CHAPTER 5 OF THE CANTON MUNICIPAL CODE REGARDING BILLBOARDS; POSTERS WHEREAS, the City of Canton, Fulton County, Illinois (the "City") is an Illinois non- home rule municipal corporation, established in accordance with the constitution of the State of Illinois of 1970; WHEREAS, pursuant to the Illinois Municipal Code, the City has authority to address billboards, as the City expressly "may license street advertising by means of billboards, sign boards,and signs and may regulate the character and control the location of billboards,sign boards, and signs upon vacant property and upon buildings." (See 65 ILCS 5/11-80-15(a)); and WHEREAS, currently, Sections 3-5-1 through 3-5-8 of the Canton Municipal Code (the "Code") contains provisions related to billboards and posters; and WHEREAS, the billboard/poster provisions of the Code need to be rescinded in light of the sign regulations set forth in Section 10-15-24 of the Code; and WHEREAS, the City Council of the City of Canton has determined that it is necessary and in the best interest of the City to rescind Sections 3-5-1 through 3-5-8 of the Code to remove the provisions related to billboards and posters. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON,FULTON COUNTY, ILLINOIS AS FOLLOWS: Section 1. The City of Canton hereby finds as fact the recitals set forth above and are incorporated herein as though fully set forth; Section 2. That Title 3, Chapter 5, Sections 3-5-1 through 3-5-8 of the Code are hereby deleted in its entirety and replaced as follows: 63-5-1: LICENSE REQUIRED: Intentionally omitted. 3-5-2: BILLBOARDS: Intentionally omitted. 3-5-3: CONSTRUCTION,HEIGHT,LOCATION: Intentionally omitted. 3-5-4: BILLPOSTING: Intentionally omitted. 3-5-5: CONSENT OF PROPERTY OWNERS: Intentionally omitted. 3-5-6: EXISTING BOARDS: Intentionally omitted. 3-5-7: LICENSE EXPIRATION: Intentionally omitted. 1 3-5-8: PENALTY: Intentionally omitted." Section 3.All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed insofar as they are in conflict with this ordinance. Section 4.If any provision of this ordinance is adjudged invalid, such adjudication shall not affect the validity of the ordinance as a whole or of any portion not adjudged invalid. Section 5. This ordinance shall be in full force and effect from and after its passage, approval and publication as required by law. PASSED AND APPROVED THIS 20TH day of FEBRUARY , 2024.
