AN ORDINANCE AMENDING SECTION 7-1-6-5 (LIEN AND PERSONAL
JUDGMENT) OF THE CANTON MUNICIPAL CODE
WHEREAS, Section 7-1-6-5 (Lien and Personal Judgment) of the Canton Municipal
Code currently states, in part, "the per hour cost of such labor will be a minimum of one hundred
fifty dollars ($150.00) and any rate greater than one hundred fifty dollars ($150.00) per hour
must be established by the city council on a yearly basis."
WHEREAS, the City Council has not increased the labor costs since 2008 (Ordinance
1935); and
WHEREAS, due to contractual increases in labor costs and the increase in the cost of
equipment and fuel since 2008, the City's actual out-of-pocket costs to cut weeds and grass and
remove litter from private property is in excess of one hundred fifty dollars ($150.00) per hours;
and
WHEREAS, the City's actual out-of-pocket costs to cut weeds and grass and remove
litter from private property is two hundred dollars ($200.00) per hour per person; and
WHEREAS, the Legal and Ordinance Committee has determined that it is necessary and
in the best interests of the citizens of Canton, Illinois to amend Section 7-1-6-5 (Lien and
Personal Judgment) to increase the costs from one hundred fifty dollars ($150.00) per hour to
two hundred dollars ($200.00) per hour per person; and
WHEREAS, the City Council has made a similar determination.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CANTON, Fulton County, Illinois, as follows:
That the foregoing recitals of fact are found to be true.
2. That Section 7-1-6-5 (Lien and Personal Judgment) of the Canton Municipal
Code be amended, in part, to read as follows:
"The per hour per person cost of such labor will be a minimum of two hundred
dollars ($200.00) and any rate greater than two hundred dollars ($200.00) per
hour per person must be established by the city council on a yearly basis."
PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular meeting
this 15th day of JUNE , 2010 upon a roll call vote as follows:
AYES• ALDERMAN WEST, SARFF, REED, SCHENCK, HARTFORD, PICKEL,
RIVERO, ELLIS.
NAYS: None
ABSENT: None
