AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO ALLOW MULTI-FAMILY
DWELLING AT THE PROPERTY CURRENTLY ZONED B-2 LOCATED AT 125 N. 4Tx
AVENUE, CANTON, ILLINOIS.
WHEREAS, it appears to the City Council of the City of Canton, Fulton County, Illinois, that
the territory herein described is located within the corporate limits of the City of Canton; and,
WHEREAS, a petition was filed by Rosolino Puleo, a prospective purchaser of the property, to
the Planning and Zoning Commission of said City requesting a special use; and,
WHEREAS, no objectors appeared at said hearing and said commission did thereupon make
favorable findings of fact and did recommend to the Canton City Council that said special use to
allow, multi-family dwelling at the property currently zoned B-2 located at 125 N. 4th Avenue,
Canton, Illinois.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CANTON, FULTON COUNTY, ILLINOIS, AS FOLLOWS:
1. That the City Council of the City of Canton, Fulton County, Illinois hereby finds the
foregoing recitals to be fact.
2. That sppecial use to allow multi-family dwelling at the property currently zoned B-2 located at
125 N. 4t Avenue, Canton, Illinois, affecting real property being legally described as follows:
Lot number 12 in Block Number 6, Kellogg & Babcock's Addition to Canton,
situated in the County of Fulton and State of Illinois.
3. That the special use is expressly contingent upon petitioner's purchase of property and will
not become effective until petitioner submits proof of ownership.
4. That the special use is expressly contingent upon petitioner providing and maintaining a
parking area with enough spaces suitable to accommodate each resident with a vehicle. Said
parking area is required, at a minimum, to be covered with white rock and maintained with an
adequate amount of white rock.
5. That the special use is expressly contingent upon the property being brought up to City Code
prior to occupancy, and all codes being met throughout occupancy, due to concern for the
welfare, health and safety of residents.
6. That the record of the City of Canton, appropriated documents, maps and related regulations
be and the same hereby are, amended to reflect the foregoing special use permit granted herein.
PASSED by the City Council of the City of Canton, Fulton County, Illinois, at a regular
meeting this 1st day of June 2010 upon a roll call vote as follows:
AYES: Alderman Sarff, Reed, Schenck, Hartford, Pickel, Ellis
NAYS: None
ABSENT: Alderman West, Rivero
