J h ~ - ORDINANCE N0. ~.~ AN ORDINANCE AUTHORIZING THE SALE OF REAL PROPERTY OWNED BY THE CITY OF CANTON, ILLINOIS WHICH PROPERTY IS GENERALLY LOCATED AT 156 SOUTH FIRST AVENUE, CANTON, FULTON COUNTY, ILLINOIS. WHEREAS, the City of Canton owns the following described real property: Fifty-five (55) feet off of the North Side of Lot Number Sixty-four (64) in Jones' Second Addition to Canton, excepting therefrom the West Sixty-five (65) feet, and also except, the following described tract of land: Beginning at an iron pin on the North line of said Lot 64 and being East 65.0 feet from the Northwest corner of said Lot 64; thence East a distance of 13.0 feet to an iron pin; thence South 0° 09' East a distance of 54.86 feet to an iron pin; thence West a distance of 13.0 feet to an existing iron pin; thence North 0° 09' West a distance of 54.88 feet to the point of beginning, situated in Fulton County, Illinois and subject to easements. which property is generally located at 156 South First Avenue, Canton, Fulton County, Illinois and is currently vacant; and WHEREAS, the corporate authorities of the City of Canton have determined that it is no longer necessary, appropriate or in the best interests of the City that it retain title to said real property, and that said real property is not required for the use of, or profitable to the City; and WHEREAS, pursuant to Section 11-76-2 of the Illinois Municipal Code, Illinois Revised Statutes, Chapter 24, Section 11-76-2, notice has been given of the proposal to sell such real property and bids have been invited for the purchase of such real property, said notice having first been published on March 28, 1978, and having been published for three successive weeks in the Canton Daily Ledger, a newspaper published in the City of Canton; and WHEREAS, pursuant to said notice, bids were opened at the regular meeting of the corporate authorities held on May 2, 1978; and WHEREAS, the following bids for the purchase of such property have been received: BIDDER The Salvation Army Gerald B. Martin AMOUNT $5,250.00 $6,000.00 and WHEREAS, the corporate authorities find and determine that the best interests of the City and its residents will be served by the acceptance of the bid submitted by The Salvation Army and the sale of the aforesaid real property to such bidder for the amount bid of five thousand two hundred and fifty dollars ($5,250.00), which amount, although it does not represent the high bid, is found to be in the best interests of the City of Canton; NOW, THEREFORE, BE IT ORDAINED BY THE CORPORATE AUTHORITIES OF THE CITY OF CANTON, ILLINOIS, AS FOLLOWS: 1. The corporate authorities find as facts the recitals hereinabove set forth. 2. The bid of The Salvation Army in the amount of five thousand two hundred and fifty dollars ($5,250.00) is hereby accepted by the corporate authorities of the City of Canton for the sale of the following described real property: Fifty-five (55) feet off of the North Side of Lot Number Sixty-four (64) in Jones' Second Addition to Canton, excepting therefrom the West Sixty-five (65) feet, and also except, the following described tract of land: Beginning at an iron pin on the North line of said Lot 64 and being East 65.0 feet from the Northwest corner of said Lot 64; thence East a distance of 13.0 feet to an iron pin; thence South 0° 09' East a distance of 54.86 feet to an iron pin; thence West a distance of 13.0 feet to an existing iron pin; thence North 0° 09' West a distance of 54.88 feet to the point of beginning, situated in Fulton County, Illinois and subject to easements. 3. The Mayor of the City of Canton is hereby authorized and directed to sign and the City Clerk is hereby authorized and directed to attest a contract for the sale and purchase of the aforesaid real property, which contract shall be in the form attached hereto as Exhibit A. 4. Upon satisfaction of the terms of the aforesaid contract and upon the payment or securing of the aforesaid bid price in the manner provided in said contract, the Mayor of the City of Canton is hereby authorized and directed to convey and transfer the aforesaid real property to The Salvation Army, an Illinois corporation, by a proper deed of conveyance, stating therein the aforesaid consideration, and the City Clerk is hereby authorized to acknowledge and attest such deed and to affix thereto the seal of the City of Canton. 5. The Mayor and the Clerk of the City of Canton are hereby authorized, respectively, to execute and attest such other documents as may be necessary to the conveyance herein authorized. 6. This Ordinance shall be in full force and effect from and after its passage by a vote of at least three-fourths of the corporate authorities now holding office, and approval in the manner provided by law.
