AN ORDINANCE APPROVING THE PURCHASE OF
BODY-WORN CAMERAS AND RELATED SYSTEM/ACCESSORIES AND
WAIVING COMPETITIVE BIDDING REQUIREMENTS
WHEREAS,the City of Canton,Fulton County,Illinois ("City"), is an Illinois non-home
rule municipality;
WHEREAS, pursuant to the Illinois Law Enforcement Officer-Worn Body Camera Act
(50 ILCS 706/10-1), as amended (the "Officer-Worn Body Camera Act"), the City is required to
implement body cameras by January 1, 2025;
WHEREAS, an "officer-worn body camera" means an electronic camera-system for
creating,generating,sending,receiving,storing,displaying,and processing audiovisual recordings
that may be worn about the person of a law enforcement officer(50 ILCS 706/10-10);
WHEREAS, in order to comply with the Officer-Worn Body Camera Act, the City is in
need of officer-worn body cameras to be used for public purposes;
WHEREAS, the City's Police Department has tested various companies' body camera
equipment and obtained quotes for same;
WHEREAS, after assessing the various companies and testing the equipment, the City's
Police Chief has recommended purchasing the officer-worn body cameras and related
system/accessories (collectively the"Body Cameras")from Axon Enterprise, Inc.;
WHEREAS,the quote from Axon Enterprise,Inc. is for$128,248.83,which shall be paid
in five(5) annual installments, substantially as shown in"Exhibit A";
WHEREAS, pursuant to 65 ILCS 5/11-61-3, the corporate authorities are authorized to
purchase personal property through contracts that provide for the consideration for such purchase
to be paid through installments to be made at stated intervals during a certain period of time, but,
in no case, may such contracts provide for consideration to be paid during a period in excess of
twenty (20)years) or provide for the payment of interest at a rate more than that permitted in "An
Act to authorize public corporations to issue bonds, other evidences of indebtedness and tax
anticipation warrants subject to interest rate limitations set forth therein",approved May 26, 1970,
as amended.
WHEREAS,the contract with Axon Enterprise,Inc. complies with the requirements of 65
ILCS 5/11-61-3;
WHEREAS,the corporate authorities find it to be clearly in the public's interest to proceed
with the purchase of the Body Cameras has agreed, by this Ordinance, by at least a vote of two-
thirds (2/3)to waive competitive bidding requirements;
WHEREAS, the City Council of the City of Canton has determined that it is necessary
and in the best interests of the City to purchase the Body Cameras for the City of Canton,
substantially as described in`Exhibit A."
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY
COUNCIL OF THE CITY OF CANTON,FULTON COUNTY, ILLINOIS AS FOLLOWS:
1. The City of Canton hereby fmds as fact the recitals set forth above and are incorporated
herein as though fully set forth;
2. Any applicable competitive bidding requirements set forth by Illinois law and the Canton
Municipal Code are hereby waived;
3. The quotation for the purchase of the Body Cameras in the total amount of$128,248.83
(with $25,649.75 due in July 2023), substantially as described in "Exhibit A," plus
necessary taxes,titles, and fees,is hereby APPROVED;
4. The Mayor, or his designee, and the Chief of Police are hereby authorized to execute and
deliver any and all purchase agreements,purchase orders,or other documents necessary to
purchase the Body Cameras, substantially as described in"Exhibit A";
5. This Ordinance shall be in full force and effective immediately upon its passage by the City
Council of the City of Canton and approval by the Mayor thereof.
PASSED AND APPROVED THIS 3rd day of July,2023.

Contract Sourcewell Contract#010720-AXN is incorporated by reference into the terms and conditions of this Agreement. In the event of conflict the terms of Axon's Master
Services and Purchasing Agreement shall govern.

This Quote is limited to and conditional upon your acceptance of the provisions set forth herein and Axon's Master Services and Purchasing Agreement
(posted at www.axon.com/legal/sales-terms-and-conditions), as well as the attached Statement of Work(SOW)for Axon Fleet and/or Axon Interview Room
purchase, if applicable. In the event you and Axon have entered into a prior agreement to govern all future purchases, that agreement shall govern to the
extent it includes the products and services being purchased and does not conflict with the Axon Customer Experience Improvement Program Appendix as
described below.

The Axon Customer Experience Improvement Program Appendix,which includes the sharing of de-identified segments of Agency Content with Axon to
develop new products and improve your product experience (posted at www.axon.com/legal/sales-terms-and-conditions),.is incorporated herein by
