ORDINANCE NO.
AN ORDINANCE ANNEXING AND REZONING CERTAIN PROPERTY IN
THE VICINITY OF THE CANTON COUNTRY CLUB ALONG NORTH
MAIN STREET AND LAICELAND PARK DRIVE
WHEREAS, the Planning and Zoning Commission of the City of
Canton, Illinois, after notice, has held a public hearing at whic'
no objectors appeared, on the question of rezoning and annexation
of certain property along North Main Street and Lakeland Park Drip
in the vicinity of the Canton Country Club and also involving the
Canton Country Club property and has recommended to the City Coun-
cil of the City of Canton that said properties be annexed to the
City of Canton and be rezoned as R-4 and R-2 properties and that
..other lands be annexed as AG-1, and,
WHEREAS, it appears that said properties are contiguous to
the corporate limits of the City of Canton, Illinois, and,
WHEREAS, all electors residing therein are included within
the petitions, and,
WHEREAS, it appears that the tracts should be zoned R-2,
single family residence, with the exception of the Canton Country
Club property West of Route 78 and the J. Judson Henninger prop-
erty which should be rezoned R-4, multiple family, and the Canton
Country Club property East of Route 78 which should be zoned AG-1,
and,
WHEREAS, it appears that said property should be annexed to
the City of Canton and rezoned as recommended, and,
WHEREAS, all notice requirements have been met,
NOW, THEREFORE, BE IT ORDAINED:
Section 1. That the following described properties be and
the same are hereby annexed to the City of Canton, Illinois.
TRACT A (CANTON COUNTRY CLUB-CLUBHOUSE. AND WEST OF HIGHWAY)
A part of the Southeast Quarter of Section 15, Town-
ship 7 North, Range 4 East of the Fourth Principal
Meridian, Fulton County, Illinois, described as follows:
Beginning at the Southwest corner of said Southeast
Quarter, thence Northerly along said quarter section
line to a point 270 feet South 0° 27' West of the
Northwest corner of the South Half of said Southeast
Quarter, thence North 90° 40' East a distance of
539.05 feet to the centerline of Illinois Route
78, thence in a Southerly direction along the
centerline of said Route 78 to the South line of
said Southeast Quarter, thence West along the
section line to the point of beginning.
TRACT B (CANTON COUNTRY CLUB-EAST OF HIGHWAY)
A part of the Southeast Quarter of Section 15,
Township 7 North, Range 4 East of the Fourth
Principal Meridian, Fulton County, Illinois,
being all of said Southeast Quarter lying east
of Illinois Route 78, .excepting therefrom the
rights of way for railroad and public highways
now existing.
TRACT C (SCHULER)
A part of the Northeast Quarter of Section 22,
Township 7 North, Range 4 East of the Fourth
Principal Meridian, Fulton County, Illinois,
described as follows: Beginning at a point
50 feet East of the Northwest corner of said
Northeast Quarter, thence South 1° 08' ~rlest
180 feet, thence East 244.01 feet, thence
North 180 feet, thence V1est 240.8 feet to the
place of beginning.
TRACT D (UIILLIAMS-D7ILBRANDT)
A part of the Northeast Quarter of Section 22,
Township 7 North, Range 4 East of the Fourth
Principal Meridian, Fulton County, Illinois
described as follows: Beginning at a point 290.8
feet East of the North Quarter corner of said
Section 22, thence East 105.0 feet, thence
running South 5 degrees 30 minutes West 160.8
feet to an iron pipe marker at an existing fence,
thence West 89.59 feet to a point, thence North
160.06 feet to the Point of Beginning, situated
in Fulton County, Illinois.
TRACT E (HERINK)
A part of the North one-third of the Northeast
Quarter of Section 22, Township 7 North, Range
4 East of the Fourth Principal Meridian, Fulton
County, Illinois, described as follows: Com-
mencing at a point 114 feet 7 1/2 inches, more
or less, South of and 140 feet, more or less,
West of an iron stake or pin situated at the
intersection of the South line of the right of
way of a public highway along the North line of
said Northeast Quarter of Section 22 with the
former West right of way of what is known as
Bond Issue Route No. 78, said point of begin-
ning being the Southwest corner of the property
now owned by Donald L. Jacobus, running thence
in a Southerly direction 123 feet, thence in an
Easterly direction 140 feet, more or less, to
an iron stake situated 237 feet 7 1/2 inches,
more or less, South of the said intersection
of the public roads, thence North 123 feet to

a point 3 feet North of an iron stake 117
feet 7 1/2 inches, more or less, South of
the said stake at the intersection of the
public roads, thence in a Westerly direction
140 feet, more or less, to the point of
beginning; EXCEPTING, however, a parcel of
land off the East side of the said described
tract, approximately 20 feet 1 inch, plus or
minus, heretofore conveyed to the State of
Illinois for highway purposes.
TRACT F (PETERSON)
Part of the North one-third of the Northeast
Quarter of Section 22, Township 7 North,
Range 4 East of the Fourth Principal Meridian,
Fulton County, Illinois, described as follows:
Commencing at a point 467.41 feet East and 72
feet and 8 inches North of the Southwest corner
of the North one-third of the Northeast Quarter
of Section 22, Township 7 North, Range 4 East
of the Fourth Principal Meridian, running thence
North 77 feet and 8 inches, thence West 200
feet, thence South 77 feet and 8 inches, thence
East 200 feet to the place of beginning; SUB-
JECT TO THE FOLLOGJING: (1) The right-of-way
to Central Illinois Public Service Company,
dated June 1, 1963 and recorded September 25
1963, in Volume 736 at Page 594, among the
Land Records of Fulton County, Illinois; (2)
Dedication to the People of the State of Il-
linois for the purpose of a public highway as
described in warranty deed, dated October 21,
1953, and recorded November 20, 1953, in Volume
629, at page 396, among the Land Records of
Fulton County, Illinois.
TRACT G (TUTT)
A part of the North one-third of the Northeast
Quarter of Section 22, Township 7 North, Range
4 East of the Fourth Principal Meridian, Fulton
County, Illinois, described as follows: Com-
mencing at the Southwest corner of the North one-
third of the Northeast Quarter of Section 22
aforesaid, running thence East 467.41 feet,.
more or less, to the West side of the Canton-
Farmington highway, being the point of beginning;
from said point of beginning running thence North
along the West side of the Canton-Farmington
highway 72 feet 8 inches, more or less, to a
point, thence West 177 feet to a point, .thence
South 72 feet 8 inches, more or less, .thence
East 177 feet to the place of beginning; ALSO
a part of the Northeast Quarter of Section 22,
Township 7 North, Range 4 East of the Fourth
Principal Meridian, described as follows:
Commencing at a point 467.41 feet East of the
Southwest corner of the North one-third of
said Northeast Quarter of said Section 22,
running thence South 5.0 feet, thence West
177 feet, thence North 5.0 feet, .and thence

TRACT H (GRAY)

Beginning at a point 20 feet South of the South-
west corner of the North one-half of the South-
east Quarter of Section 15, thence East 539.05
feet, to the center of Illinois Route 78, thence
Northerly 236 feet along the centerline of said
Route 78, thence West 605 feet, more or less,
thence South 216 feet, thence East 75 feet,
thence South 20 feet to the place of beginning.
TRACT I (HENNINGER)
Part of the Southeast Quarter of Section 15,
Township 7 North, Range 4 East of the Fourth
Principal Meridian, Fulton County, Illinois,
described as follows, to wit: Commencing at
the Southeast corner of the North Half of the
Southeast Quarter, town and range aforesaid,
thence West 2,080.4 feet to the centerline
of Route 78, thence South 20.00 feet to the
point of beginning, thence South 1 degree
06 minutes East along the center of Route 78,
250 feet, thence North 89 degrees 20 minutes
West 539.05 feet, thence North 0 degrees 27
minutes East 250 feet, thence East 539.05
feet to point of beginning, containing 3.088
acres, plus or minus, except that portion
dedicated for road purposes and right of
way to the State of Illinois.
Section 2. That Tract A (the Canton Country Club property
West of Route 78 and Tract I (the J. Judson Henninger property) be
and the same are hereby rezoned R-4 and Tracts C through H be
and the same are hereby rezoned R-2. Tract B (the Canton Country
Club property East of Route 78) is zoned AG-l.
Section 3. That this Ordinance shall be in full force and
effect upon adoption by majority vote of the City Council of the
City of Canton and upon signature by the mayor.
Section 4. That the appropriate changes shall be made in the
zoning maps and said changes recorded as provided by law.
