HomeMy WebLinkAboutResolution #5431RESOLUTION NO. 5431 A RESOLUTION AUTHORIZING TRANSFER OF CERTAIN REAL ESTATE LOCATED AT OR ABOUT 430 E. OAK STREET, CANTON, ILLINOIS TO FULTON COUNTY WHEREAS, the City of Canton, Fulton County, Illinois (the "City") is an Illinois non - home rule municipal corporation, established in accordance with the constitution of the State of Illinois of 1970; WHEREAS, the Illinois Local Government Property Transfer Act (50 ILCS 605/1 et seq.) (the "Act') authorizes the City to transfer real property to another municipality for a public improvement or any public purpose; WHEREAS, Fulton County, Illinois (the "County") owns real property located at or about 430 E. Oak Street, Canton, IL 61520 and has used said property as its highway department for several years; WHEREAS, the County is a "municipality" as defined in the Act; WHEREAS, to the extent the City owns any of the real property described in "Exhibit All (the "Property") located at or about 430 E. Oak Street, the City and County desire for the City to transfer said Property to the County to be used for a public improvement or other public purpose; WHEREAS, the corporate authorities of the City believe it to be in the best interests of the City to transfer the Property to the County, subject to the terms and conditions of this Resolution. BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CANTON, ILLINOIS, AS FOLLOWS: 1. The City of Canton hereby finds as fact the recitals set forth above and are incorporated herein as though fully set forth; 2. Upon the County declaring by Ordinance that the Property is necessary or convenient for it to use, occupy or improve in the making of any public improvement or for any public purpose and receipt of One Dollar ($1.00) consideration, then the City is hereby authorized to transfer any right, title and interest it may have in the Property to the County by Quit Claim Deed. 3. The Mayor and City Clerk are hereby authorized to execute the Quit Claim Deed and any other documents necessary to accomplish the foregoing. 4. That this Resolution shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Illinois and approval by the Mayor thereof. Smi -Walters, Acting City Clerk EXHIBIT A Parcel 1: Lots 1, 2, 3, 4, 5 and 6, except 20.44 feet off the South side of said Lot 6 in Marshall and Fisher's First Addition to City of Canton, County of Fulton and State of Illinois; also, that portion of South Fourth Avenue in the City of Canton, Fulton County, Illinois directly adjacent to Lots 1, 2, 3, 4, 5, and 6 excepting the south 20.44 feet of said Lot 6 as vacated per Petition filed Jan 27, 1907 and recorded March 22, 1910 in the Recorder's Office of Fulton County, Illinois, as document #172824, recorded in Volume 288 of the Land Records, Page 584. Parcel 2: All Lot 7 and Lot 8 and 20.44 feet off the South side of Lot 6, in Marshall and Fisher's First Addition to the City of Canton, County of Fulton and State of Illinois; also, that portion of South Fourth Avenue in the City of Canton, Fulton County, Illinois directly adjacent to Lots 7, 8 and 20.44 feet off the South side of Lot 6 as vacated per Petition filed Jan 27, 1907 and recorded March 22, 1910 in the Recorder's Office of Fulton County, Illinois, as document #172824, recorded in Volume 288 of the Land Records, Page 584. Parcel 1 and 2 more particularly described as follows: Beginning at the Northeast corner of Lot 1 in Marshall and Fisher's First Addition to City of Canton, recorded In the Recorder's Office of Fulton County, Illinois December 10, 1904; thence South 00 degrees 45 minutes 53 seconds West on the east line of Lots 1 thru 8 of said Marshall and Fisher's Addition, 374.23 feet to the southeast corner of Lot 8 of said Addition also being the north right of way line of Hickory Street; thence on the south line of said Lot 8 South 89 degrees 21 minutes 27 seconds West, to the southwest corner of said Lot 8, 162.35 feet; thence continuing South 89 degrees 21 minutes 27 seconds West along the extension of the south line of Lot 8, and the north right of way line of Hickory Street to the west right of way line of vacated Fourth Avenue, 33.01 feet; thence North 00 degrees 45 minutes 53 seconds East on said west right of way line of said vacated Fourth Avenue, 374.25 feet to an extension of the north line of Lot 1 and the south right of way line of Oak Street; thence on said line North 89 degrees 21 minutes 44 seconds East, 33.01 feet to the Northwest corner of Lot 1 of said Marshall and Fisher's Addition; thence continuing on said line North 89 degrees 21 minutes 44 seconds East, 162.35 feet to the point of beginning.
