A RESOLUTION APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF CANTON AND ILLINOIS FRATERNAL ORDER OF POLICE LABOR COUNCIL, UNIT #840 REGARDING SCHOOL RESOURCE OFFICERS WHEREAS; 'the City of'Canton (the "City") and the .Illinois Fraternal Order of Police Labor Council, Unit- #.840 ("Union") are parties ,to a :Collective Bargaining Agreement`effective May 1, 2021— April 10, 2024; WHEREAS, the City and Union have negotiated a Memorandum of Understanding. ("MOU") relative to school resource officers due to the recent Intergovernmental Agreement entered into with the Canton Union School District No. 66; and WHEREAS, the City Council of the City of Canton, Illinois has determined that it is necessary and in the best interests of the City to approve the MOU. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Canton, Fulton County, Illinois. as follows: I . That the MOU between the City and the Union, substantially in the form as attached hereto as "Exhibit A;" is hereby approved, and said MOU is to be subject to and effective pursuant to the terms and conditions set forth therein. 2. That the Mayor and City Clerk of Canton, Illinois are hereby authorized and directed to execute and deliver the MOU on behalf of the City of Canton. 3. Prior to the Mayor:and City Clerk: executing, the -City Attorney is hereby authorized i to negotiate and make. any make •any revisions necessary to the MOU to substantially accomplish the foregoing -And the purpose of the attached 1VMOU, subject to approval by; the Mayor. 4. This Resolution shall be in full force and effect immediately upon the passage and approval of this Resolution and upon execution of the MOU by the Union. PASSED THIS 23rd day of March, 2023. AYES: Alderpesons Chamberlin, Lovell, Grimm, Hale, Lingenfelter, Gossett NAYS: None ABSENT:Alderpersons Nelson, Fritz APPROVED THIS 23rd day of March, 2023 ..10,30 V4.1drea EXHIBIT A Memorandum. of Understanding School Resource Officers (SRO) This'Memorandum of Understanding ("MOU") ,is entered between the City of Canton, an Illinois municipal, corporation ( City. ) and the Illinois Fraternal Order of Police Labor Council, Unit -4840. The City and Union are parties to a certain Collective Bargaining Agreement, executed February 20, 2022, and effective May 1, 2021 through April 30, 2024 (the "Contract"). The City recently entered into.'an. Intergovernmental Agreement in Eebruary2023 with the Canton Union School District No: 66 in relation providing :an additional School Resource Officer (SRO) to be utilized at Canton schools and school -related activities/events, and the City= intends to hire and assign an additional full-time commissioned officer to the specialty, position. The City is not obligated to provide any number of SROs under the .Contract or the Intergovernmental Agreement; however; at the time of this MOU,- the City intends to provide for two (2) SRO specialty position assignments. The parties agree and acknowledge that, pursuant to Section 3.7 of the Contract, the Chief of Police may assign specialty position shifts (including the- SRO) in his or' her sole: discretion. During periods of school recess, the Chief of Police may assign the SROs to other. shifts (e.g. summer recess, winter recess, etc.). In order to avoid disagreements between the assigned SROs, and. in the event that there is more than one '(1) SRO; the- City and the Unioa,agree that in the event the Chief of Police desires to assign SROs to different shifts,, then, the SROs will :be able to bid on their,preferred shift (as selected by the Chief of.Police) by seniority. For example; and for the avoidance of doubt, if the Chief of Police wishes to assign the SROs_ to lst aria:2"d shift.during summer recess, then the more senior SRGwill be ableto.bid his or her preference between 0 and 2°d shift: The City and the Union also acknowledge the importance having properly trained SROs present during school hours and/or events and activities, to the extent possible. As such, the Union agrees that, in the event there are multiple SROs, that both SROs shall not schedule vacation during the same time, and the Chief reserves the right to deny both SROs from taking, vacation at the same `time, regardless of any bidding for; same. Aiy assigned SROs) , are encouraged to: minimize the use of vacation and/or personal days _during times. when. school is in session. Nothing in this Agreement shall be deemed a waiver of the rights of the Chief of Police to approve and/or deny any leave as otherwise permitted in the Contract. The Intergovernmental Agreement also provides for other officers' (other than SROs) potentially being provided for various school -sponsored events and/or -extra -curricular activities. Notwithstanding the 'Chief of Police's authority to assign an SRO to cover, those events and activities,. the Chief of Police or his/her designee may post a list for various- school -sponsored activities 'and/or extra -curricular activities (e.g. football games) for officers to sign-up for coverage. The Chief Of Police reserves the°right to deny. any. officer for signing up for such a shift in his or her sole discretion. Page 1 of 2 Nothing in this MOU shall be deemed a waiver of the Chief of Police's authority to assign SROs at his or her discretion, including but not limited to coverage for extra -curricular activities or other school -sponsored event, nor shall anything in this MOU be deemed a waiver of the rights of the Chief of Police to transfer employees under the Contract. This MOU will become effective as of the date this MOU is signed by the City and the Union. This MOU shall not be deemed precedential. The Union agrees that it may not rely upon this MOU for purposes of past practice and the execution of this MOU is not binding upon the City for any other bargaining unit employees (past or future).
