RESOLUTION NO. 3 59 A RESOLUTION CONCERNING THE WATER RATE SCHEDULE FOR THE HUMANE SOCIETY OF FULTON COUNTY, ILLINOIS (CODE 8-10-5(c)) WHEREAS, the County of Fulton and the City of Canton are separate units of local government, which provide animal control services, have their separate animal shelters and animal control officers; and WHEREAS, the Humane Society of Fulton County, Illinois (hereinafter "Humane Society") is anot-for-profit corporation duly organized and existing under and by virtue of the laws of the State of Illinois which provides charitable services involving the humane treatment of animals within Fulton County, Illinois; and WHEREAS, the Humane Society, the County of Fulton and the City of Canton by and through their respective governing bodies entered into an Agreement for Animal Shelter for the construction of an animal shelter at 22988 Illinois 9 Highway, Canton, Illinois; and WHEREAS, upon completion of construction, the Humane Society shall lease the premises to the County of Fulton and the City of Canton for use as an animal shelter subject to the terms of the Agreement for Animal Shelter; and WHEREAS, the County of Fulton and the City of Canton, as lessees of the premises, desire to connect to existing water mains of the City of Canton, Illinois; and WHEREAS, the Canton City Code pertaining to water rates provides, in part, as follows: "All users outside the City limits shall pay two hundred percent (200%) of the applicable rates, except as otherwise provided by the City Council." (Code No. 8-10-5(c)); and WHEREAS, the County of Fulton and City of Canton, as lessees of the animal shelter premises will be a water user outside of the City limits of the City of Canton, Illinois; and WHEREAS, the City Council of the City of Canton, Illinois has determined that it is desirable and in the best interests of the City of Canton to provide water services to the County of Fulton and City of Canton, as lessees of the animal shelter at one hundred percent (100%) of the applicable rates pursuant to Code No. 8-10-5(c). NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CANTON, FULTON COUNTY, ILLINOIS, AS FOLLOWS: 1. That the City Council finds as facts the recitals hereinabove set forth. 2. That the County of Fulton and City of Canton, as lessees of the facility at 22988 Illinois 9 Highway, Canton, Illinois shall be charged one hundred percent (100%) of the applicable water rates for water service furnished to the animal shelter for the duration of the lease. At no time shall the rates for water and sewer services furnished to the County of Fulton s .- and City of Canton, as lessees of the facility, exceed the rates charged to general public consumers residing within the City of Canton, Illinois. The County of Fulton and City of Canton understand that the schedule of rates for water service furnished to general public consumers residing within the City of Canton, Illinois are subject to modification by the City Council of the City of Canton, Illinois from time to time. 3. That the above described rate is being extended to the County of Fulton and City of Canton at the above stated address only. Any cessation of the use of this property as an animal shelter shall automatically terminate this rate. This reduced rate is not transferable by the County of Fulton and City of Canton and shall not be valid at any other address. 4. That this Resolution shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Illinois and approval by the Mayor thereof. PASSED by a majority vote of the City Council of the City of Canton, Illinois and APPROVED by the Mayor thereof this 6tn day of June , 2006, upon a roll call vote as follows: AYES: Aldermen Reed, 5che~nck, Carl, 5artf, West:, Hart:forcl..
