HomeMy WebLinkAboutResolution # 3748RESOLUTION NO 3748 WHEREAS, on a recurring basis, the City of Canton is required to award public works construction contracts to the lowest responsible bidder, and WHEREAS, the city must in each such bidding matter render a determination of whether a bidder is "responsible" or not, and WHEREAS, the city desires to further define the term "responsible bidder" with regard to projects involving funds for public works construction projects over $100,000; NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Canton, Illinois as follows: 1. The term "responsible bidder" as the same be utilized in connection with the awarding of construction contracts shall be defined to mean a bidder who meets all of the following criteria: a. Compliance with all laws required to do business in the State of Illinois and the City of Canton b. Evidence of compliance with (1) Federal Employer Tax Identification Number or, if an individual, Social Security number (2) Provisions of what is commonly known as the Equal Opportunity Employer law being 2000 (e) of Chapter 21, Title 42 of the United States Code and Federal Executive order No. 11244 as amended by Federal Executive order No. 11375. (3) Certificate of insurance with the following minimum coverage amounts: general liability, completed operations, automobile and product liability- $1,000,000. Workers Compensation $500,000 and Commercial Umbrella at $5,000,000. (4) Compliance with the Illinois Prevailing Wage Act, 820 ILLS 130/0.01 et seq (5) Participation in apprenticeship and training programs approved and registered with the United States Department of Labor's Bureau of Apprenticeship and Training (6) Written statement regarding zero tolerance for harassment of any type (7) At the discretion of the City Council of the City of Canton, a wage and welfare bond with the amount of same to be contingent upon the costs associated with the project for which bids are being sought BE IT FURTHER RESOLVED, that nothing herein contained shall be construed to affect any suit or proceeding now pending in any court nor any right accrued or liability incurred by any prior Resolution, Ordinance or Action by this City Council. BE IT FURTHER RESOLVED, that this Resolution shall be in full force and effect immediately upon its adoption. PASSED by the City Council of the City of Canton, Illinois this jth day of March, 2006.
