AN ORDINANCE TO PROPOSE THE RATIFICATION OF AN AMENDMENT TO
THE BUSINESS DEVELOPMENT DISTRICT REDEVELOPMENT PLAN
AND ESTABLISH A DATE FOR A SECOND PUBLIC HEARING
for the
FIRST AMENDMENT TO THE
CANTON BUSINESS DEVELOPMENT DISTRICT NO. 1
PREAMBLE
WHEREAS, the "Business District Development and Redevelopment Act", 65 ILCS 5/11-
74.3-1 et. seq., as amended (hereinafter referred to as the "Act") provides for municipalities to create
and amend within their corporate boundaries business development districts;and
WHEREAS, on March 15, 2022, the City of Canton, Fulton County, Illinois (the "City")
approved Ordinance No. 4281: Designating and Approving the Canton Business Development
District No. 1 (the "Business District") and Imposing a Retailer's Occupation Tax and Service
Occupation Tax and Hotel Operators'Occupation Tax for the Canton Business Development District
No. 1 Redevelopment Area (the"Area");and
WHEREAS, on September 6,2022,and pursuant to Section 11-74.3-2(a) of the Act,the City
approved Ordinance No. 4300 to propose the approval of an amendment to the Business District and
establish a date for a public hearing;and
WHEREAS, pursuant to Section 11-74.3-2(b) of the Act, arrangements were made by the
City for notice in respect to said Public Hearing to be given by publication in the Canton Daily Ledger
on September 8,2022,and September 9,2022;and
WHEREAS, pursuant to Section 11-74.3-2(c) of the Act, the City Council caused a Public
Hearing to be held on September 20, 2022, relative to the approval of the First Amendment to the
Business District at the Canton City Train Depot Building,50 N. 4th Avenue,Canton,Illinois.At said
Public Hearing, all interested persons were given an opportunity to be heard on the question of the
designation of the Amended Business District Redevelopment Project Area,the approval of the First
Amendment to the Business District Redevelopment Plan, and the imposition of Business
Development District taxes and issuance of any obligations by the City to provide for the payment of
eligible business district project costs;and
WHEREAS, on September 20,2022,the City approved Ordinance No. 4307 to approve the
First Amendment to the Business District and impose a Retailers' Occupation Tax, Service
Occupation Tax and Hotel Operators' Occupation Tax for the Business District as Amended;and

WHEREAS, on October 3, 2022, the City verified notice in respect to said Public Hearing
was published in the Canton Daily Ledger on September 8,2022,but the City was unable to verify that
notice in respect to said Public Hearing was published in the Canton Daily Ledger on September 9,2022;
and
WHEREAS,the City now desires to undertake further action to ratify the First Amendment
to Canton Business Development District No. 1 (the "First Amendment") that was approved on
September 20,2022,and ensure notice in respect to a Second Public Hearing to be held relative to the
approval of the First Amendment to the Business District shall be given at least twice, the first
publication to be not more than thirty (30) nor less than ten (10) days prior to the Public Hearing,in
a newspaper of general circulation within the municipality;and
WHEREAS,pursuant to Section 11-74.3-2 of the Act, the City Council will cause a Second
Public Hearing to be held on the proposed First Amendment to the Canton Business Development
District No. 1;and
WHEREAS,at the Second Public Hearing,any interested person may file written objections
with the City Clerk and may be heard orally with respect to any matters embodied in the public notice
of the Second Public Hearing. The City shall hear and determine all alternate proposals or bids for
any proposed conveyance of land by the City and located within the proposed amended business
district and all protests and objections at the hearing.
NOW,THEREFORE,be it ordained by the Mayor and City Council of the City of Canton,
Fulton County,Illinois as follows:
1. The recitals set forth in the preamble to this Ordinance are hereby incorporated by reference
as if fully set forth herein.
2. The Second Public Hearing for the First Amendment to the Canton Business Development
District No. 1 shall be held at 5:30 p.m. on October 25, 2022, at the Canton City Train
Depot Building,50 N.4th Avenue, Canton,Illinois.
3. This Ordinance shall be in full force and effect from and after its passage and approval as
provided by law and shall take effect upon its passage as required by law.

Canton,Fulton County,Illinois this 10`h day of October,2022 and filed in the office of the City Clerk
of said City on that date.
