HomeMy WebLinkAboutOrdinance #4304 ORDINANCE NO. t 3' 0 LI AN ORDINANCE GRANTING A PETITION FILED BY THE CALVARY BAPTIST CHURCH OF CANTON AND ANNEXING TERRITORY OWNED BY THE CALVARY BAPTIST CHURCH OF CANTON WHEREAS, Section 7-1-8 of the Illinois Municipal Code(65 ILCS 5/7-1-8)provides: Any territory which is not within the corporate limits of any municipality but which is contiguous to a municipality at the time of annexation and which territory has no electors residing therein, or any such territory with electors residing therein,may be annexed to the municipality in the following manner: a written petition signed by the owners of record of all land within such territory and by at least 51% of the electors residing therein shall be filed with the municipal clerk. The petition shall request annexation and shall state that no electors reside therein or that at least 51% of such electors residing therein join in the petition, whichever shall be the case, and shall be under oath. The corporate authorities of the municipality to which annexation is sought shall then consider the question of the annexation of the described territory. A majority vote of the corporate authorities then holding office is required to annex. The vote shall be by "yeas" and "nays" entered on the legislative records.A copy of the ordinance annexing the territory together with an accurate map of the annexed territory shall be recorded with the recorder and filed with the County Clerk within the county wherever the annexed territory is located. WHEREAS,the Calvary Baptist Church of Canton is the owner of certain territory,legally described as follows: A part of the Southwest Quarter of Section 28, Township 7 North, Range 4 East of the Fourth Principal Meridian, Fulton County, Illinois,more particularly described as follows and bearings are for descriptive purposes only: Commencing at a drill hole at the Center of said Section 28; thence along the east line of the Southwest Quarter of said Section 28 bearing South 00 degrees 45 minutes 23 seconds West,a distance of 914.83 feet to the southeast corner of the Canton Moose Lodge property and the Point of Beginning of the parcel to be described: From the Point of Beginning; thence continuing along said east line bearing South 00 degrees 45 minutes 23 seconds West, a distance of 614.46 feet to the northeast corner of the Calvary Baptist Church property; thence bearing South 89 degrees 46 minutes 05 seconds West, a distance of 417.40 feet to an iron rod at the northwest corner of said Calvary Baptist Church property; thence bearing North 00 degrees 45 minutes 23 seconds East, a distance of 596.61 feet to an iron rod; thence bearing North 44 degrees 15 minutes 48 seconds West, a distance of 35.19 feet to an iron rod; thence bearing South 89 degrees 16 minutes 39 seconds East, a distance of 42.42 feet to a concrete marker at the southwest corner of the Canton Moose Lodge property; thence bearing South 89 degrees 16 minutes 39 seconds East,a distance of 399.81 feet to the Point of Beginning,containing 5.927 acres more or less. Subject to the rights, if any, of the public for roadway purposes along the east side of the above described parcel. NOTE: TOTAL AREA TO BE ANNEXED INCLUDES THE ABOVE 5.927 ACRE± PARCEL AND THAT PORTION OF NORTH AVENUE "I" RIGHT OF WAY LYING EAST OF SAID PARCEL. WHEREAS, an accurate map of the Property is attached hereto as "Exhibit B"; WHEREAS, the City Council of the City of Canton has determined that it is necessary and in the best interest of the City to annex the Property and expand the corporate limits of the City of Canton, Illinois. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON,FULTON COUNTY, ILLINOIS AS FOLLOWS: 1. The City hereby finds as fact the recitals set forth above and are incorporated herein as though fully set forth; 2. The Petition for Annexation filed by the Calvary Baptist Church of Canton is hereby GRANTED; 3. The City Treasurer is directed to pay all recording or filing fees necessary to accomplish the foregoing; and 7. This Ordinance shall be in full force and effective immediately upon its passage by the City Council of the City of Canton and approval by the Mayor. The law provides that territory contiguous to a Municipality may be annexed upon petition signed by ALL the owners of such land and by at least 51%of the electors residing thereon, if any.Such annexation is initiated by the filing of a written petition signed by said owners of record and said voters residing thereon. It is absolutely necessary that ALL the owners and ALL the voters sign this petition if annexation is to be accomplished in this manner. 2. All those persons signing the petition must do so before a Notary Public, and their names should be filled in the space provided on the reverse side for the Jurat of such Notary Public. 3. The complete legal description for each parcel of land sought to be annexed by this petition should be set out in the space provided or presented on a separate page(s)and attached hereto. 4.
