AN ORDINANCE TO PROPOSE THE APPROVAL OF AN AMENDMENT TO THE
BUSINESS DEVELOPMENT DISTRICT REDEVELOPMENT PLAN
AND ESTABLISH A DATE FOR A PUBLIC HEARING
for the
FIRST AMENDMENT TO THE
CANTON BUSINESS DEVELOPMENT DISTRICT NO. 1
PREAMBLE
WHEREAS, the "Business District Development and Redevelopment Act", 65 ILCS 5/11-
74.3-1 et. seq., as amended (hereinafter referred to as the "Act") provides for municipalities to create
and amend within their corporate boundaries business development districts; and
WHEREAS, on March 15, 2022, the City of Canton, Fulton County, Illinois (the "City")
approved Ordinance No. 4281: Designating and Approving the Canton Business Development
District No. 1 (the `Business District") and Imposing a Retailer's Occupation Tax and Service
Occupation Tax for the Canton Business Development District No. 1 Redevelopment Area (the
"Area"); and
WHEREAS, the City now desires to amend the Canton Business Development District No.
1 (the"First Amendment") to add property to the Area and add projects to the Redevelopment Plan;
and
WHEREAS, pursuant to Section 11-74:3-2 of the Act, the City Council must cause a Public
Hearing to be held on the proposed First Amendment to the Canton Business Development District
No. 1; and
WHEREAS, pursuant to Section 11-74.3-2 of the Act, the City shall provide notice of this
Public Hearing by publication. Notice by publication shall be given at least twice,the first publication
to be not more than thirty (30) or less than ten (10) days prior to the Public Hearing, in a newspaper
of general circulation within the municipality; and
WHEREAS,at the Public Hearing,any interested person may file written objections with the
City Clerk and may be heard orally with respect to any matters embodied in the public notice of the
Public Hearing. The City shall hear and determine all alternate proposals or bids for any proposed
conveyance of land by the City and located within the proposed amended business district and all
protests and objections at the heating.

NOW,THEREFORE,be it ordained by the Mayor and City Council of the City of Canton,
Fulton County,Illinois as follows:
• 1. The recitals set forth in the preamble to this Ordinance are hereby incorporated by reference
as if fully set forth herein.
2. The Public Hearing for the First Amendment to the Canton Business Development District
No. 1 shall be held at 5:30 p.m. on September 20, 2022, at the Canton City Train Depot
Building, 50 N. 4th Avenue, Canton, Illinois.
3. This Ordinance shall be in full force and effect from and after its passage and approval as
provided by law and shall take effect upon its passage as required by law.
PASSED, APPROVED AND ADOPTED, by the Corporate Authorities of the City of
Canton,Fulton County,Illinois this 6`h day of September,2022 and filed in the office of the City Clerk
of said City on that date.
