HomeMy WebLinkAboutResolution #0770 RESOLUTION NO. ~ rJ O A RESOLUTION AUTHORIZING THE EXECUTION OF A MUTUAL AID AGREEMENT BETWEEN THE CITY OF CANTON AND ASTORIA FIRE PROTECTION DISTRICT, BUCKHEART TOWNSHIP FIRE PROTECTION DISTRICT, CANTON COMMUNITY FIRE PROTECTION DISTRICT, CUBA FIRE PROTECTION DISTRICT, FAIRVIEW FIRE PROTECTION DISTRICT, FIATT FIRE PROTECTION DISTRICT, IPAVA FIRE PROTECTION DISTRICT, LEWISTOWN FIRE PRO- TECTION DISTRICT, LONDON MILLS FIRE PROTECTION DISTRICT, TABLE GROVE FIRE PROTECTION DISTRICT AND VERMONT FIRE PROTECTION DISTRICT. t,'HEREAS, it is in the best interests of the City of Canton, Illinois that a certain mutual aid agreement between the City of Canton and Astoria Fire Protection District, Buckheart Township Fire Protection District, Canton Community Fire Protection District, Cuba Fire Protection District, Fairview Fire Protection District, Fiatt Fire Protection District, Ipava Fire Protection District, Lewistown Fire Protection District, London Mills Fire Protection District, Table Grove Fire Protection District and Vermont Fire Protection District, a copy of which is attached hereto and a made a part hereof and designated as Exhibit A,be entered into; and ~+THEREAS, Chapter 24, Section 11-6-1 of the Illinois Revised Statutes, as amended, provides, in part, that the corporate authorities of any municipality may enter into contracts or agreements with other municipalities and fire protection districts for mutual aid consisting of furnishing equip- went and manpower from and to such other municipalities and fire protection districts; and WHEREAS, the corporate authorities, after due investigation and con- sideration have determined that entering into the mutual aid agreement in the form of Exhibit A hereto will serve the public good and benefit the City of Canton; NOtd, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CANTO::, ILLINOIS, AS FOLLOWS: 1. That the Mayor and City Council of the City of Canton, Illinois hereby find as facts all of the recitals in the preamble of this resolution, as well as the preambles contained in the mutual aid agreement in the form of Exhibit A hereto. 2. That the Mayor is authorized and directed to execute, and the Clerk is directed to attest the mutual aid agreement, a copy of which is attached hereto as Exhibit A and made a part hereof. 3. That this Resolution is adopted pursuant to the provisions set forth in Chapter 24 of the Illinois Revised Statutes, 1977, Section 11-6-1. 4. That this resolution ,shall be in full force and effect upon its passage by the City Council of the City of Canton, Illinois and approval by the Mayor thereof. WHITES MUTUAL AID AGREEMENT ao~r/ THIS MUTUAL AID AGREEMENT made and entered into on the day of ~ l'~t 1~1 t , 19 7 ~ by and between all of undersigned parties hereto, being the Trustees of Fire Protection Districts, a municipal corpora- tion, or being the Mayors, and Clerks of Cities having Fire Departments, or being the President and Village Clerks of Villages having Boards of Trustees who operate Fire Departments, each does hereby agree, one with the other, and all of the parties, each with the other, to the following terms, conditions and convenants, WITNESSETH: WHEREAS, in cases of emergency, firemanship training or a fire preven- tion program arising within the territories of the respective parties hereto in which instances either party may require additional equipment and/or per- sonnel. LANGUAGE: Any department requesting aid shall, for convenience, be hereinafter referred to as the calling department. Any department of whom aid is requested shall, for convenience, be hereinafter referred to as the responding department. The fire chief or his duly authorized commanding officer in charge shall, for convenience, be hereinafter referred to as chief. AGREEMENT: 1. Upon request by the chief of a member department to the chief of any other member department, equipment and personnel of the responding de- partment will be dispatched to any point within the firefighting jurisdic- tion of the calling department as designated by the chief of the calling department. 2. Any dispatch of equipment and personnel persuant to this agreement is subject to the following conditions: (a) Any request for aid hereunder shall include a statement of the amount and type of equipment and number of personnel requested, and shall specify the location to which the equipment and personnel are to dispatched, but the amount and type of equipment and number of personnel to be furnished shall be determined by the chief of the responding department. (b) The responding department shall report to the chief of the calling department at the location to which the equipment is dispatched and shall be subject to the orders of the official. (c) The responding department shall be released by the calling department when the services of the responding department are no longer requir- ed or when the responding department is needed within the area for which it normally provides fire protection. (d) In the event of a crash of aircraft owned and operated by the United States Government, Military Aircrafts or any Foreign Nation within the area, the chief of the 182nd Tactical Air Support Group Fire Department may assume full command upon his arrival at the scene of the crash. (e) In the event of a crash of any commercial or private aircraft within the area, the chief of the Greater Peoria Airport Authority Fire Depart- ment may assume full command upon his arrival at the scene of the crash. 3. All of the above conditions shall apply equally to equipment and personnel dispatched for purposes of standby or move up. 4. Each party waives all claims against every other party for compen- sation for any loss damage, personal injury, or death occurring as a consequence of the performance of this agreement. S. No party shall be reimbursed by any other party for any costs incurred pursuant to this agreement. 6. All equipment used by the responding department in carrying out this agreement, will, at the time of action hereunder, be owned by it; and all personnel acting for the responding department under this agreement will, at the time of such action, be an employee or volunteer member of the responding department.
