HomeMy WebLinkAboutResolution #5366 RESOLUTION NO. 5366 A RESOLUTION REPORTING THE NEED OF CONFIDENTIALITY OR CONFIDENTIAL TREATMENT OF CLOSED MEETING MINUTES PURSUANT TO THE ILLINOIS OPEN MEETINGS ACT WHEREAS, Section 2.06(d) of the Illinois Open Meetings Act (5 ILCS 120/2.06) provides: (d) Each public body shall periodically meet to review minutes of all closed meetings. Meetings to review minutes shall occur every 6 months, or as soon thereafter as is practicable, taking into account the nature and meeting schedule of the public body. Committees which are ad hoc in nature shall review closed session minutes at the later of(1) 6 months from the date of the last review of closed session minutes or (2) at the next scheduled meeting of the ad hoc committee. At such meetings a determination shall be made, and reported in an open session that (1) the need for confidentiality still exists as to all or part of those minutes or (2) that the minutes or portions thereof no longer require confidential treatment and are available for public inspection. The failure of a public body to strictly comply with the semi-annual review of closed session written minutes, whether before or after the effective date of this amendatory Act of the 94th General Assembly, shall not cause the written minutes or related verbatim record to become public or available for inspection in any judicial proceeding, other than a proceeding involving an alleged violation of this Act, if the public body, within 60 days of discovering its failure to strictly comply with the technical requirements of this subsection,reviews the closed session minutes and determines and thereafter reports in open session that either(1) the need for confidentiality still exists as to all or part of the minutes or verbatim record, or (2) that the minutes or recordings or portions thereof no longer require confidential treatment and are available for public inspection. WHEREAS, the City Council of the City of Canton has reviewed its closed meeting (or "Executive Session")minutes,having occurred from September 6,2021 to April 19,2022, in order to report whether(1) the need for confidentiality still exists as to all or part of those minutes or(2) whether the minutes or portions thereof no longer require confidential treatment and are available for public inspection; and WHEREAS,the City Council believes the need for confidentiality still exists to all or part of said closed meeting minutes. NOW,THEREFORE,be it resolved by the City Council of of the City of Canton,Illinois, the following: 1. A need for confidentiality still exists for the closed meeting minutes, and verbatim record from said closed meetings, from September 6, 2021 to April 19, 2022, with the exception of those set forth in Paragraph 2 below. 2. The following closed meeting minutes (or portions thereof) from September 6,2021 to April 19, 2022 no longer require confidential treatment and are available for public inspection: NONE 3. The City Clerk is hereby instructed to snake the closed meeting minutes included in Paragraph 2, if any, available to the public for inspection and/or review. The City Clerk is instructed to partially redact any portion of the minutes that contain information that has not been approved by the City Council for public inspection. 4. This Resolution shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois. PASSED THIS 19th day of April, 2022.
