DATED AT CANTON, ILLINOIS, THIS 16 DA OVEMBER 2021 Diana Pavley-Rock, MMC, City Clerk Seal City of Canton, Illinois ORDINANCE NO. 4263 AN ORDINANCE TO REPEAL CANTON MUNICIPAL CODE TITLE 1, CHAPTER 24, SECTIONS 1 THROUGH 3 (ORDINANCE NO. 4080) WHEREAS, the City of Canton, Fulton County, Illinois (the "City") is an Illinois non- home rule municipal corporation, established in accordance with the Constitution of the State of Illinois of 1970; WHEREAS, on or about July 5, 2017, the City adopted Ordinance No. 4080, which amended the City's Municipal Code to.establish the position of Director of Public Safety for the protection of public health, safety,morals, and welfare; WHEREAS, the City is desirous of exercising its authority to remove the position of Director of Public Safety and repeal Title 1, Chapter 24, Sections 1 through 3 (Ordinance No. 4080) of the Canton Municipal Code in its entirety; WHEREAS,it is the intent of the City that upon repeal of Ordinance No. 4080,the duties assigned to the Director of Public Safety shall revert back to the Chief of Police, for the management and effectuation of the duties of the Canton Police Department,and the Chief of Fire Department, for the management and effectuation of the duties of the Canton Fire Department, respectively. Such duties of the Chief of Police and Chief of Fire Department shall be as prescribed by Illinois law and the Canton Municipal Code. WHEREAS,the City Council of the City of Canton have determined that it is necessary and in the best interest of the City to remove the position of Director of Public Safety. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, FULTON COUNTY, ILLINOIS AS FOLLOWS: 1. The City hereby finds as fact the recitals set forth above and are incorporated herein as though fully set forth; 2. Effective December 1, 2021, Title 1, Chapter 24, Sections 1 through 3 (Ordinance No. 4080) of the Canton Municipal Code shall be and hereby is repealed. Consistent herewith, the following, as denoted by strikeout, shall be deleted from the Canton Municipal Code: SECT40N 1 24 a. Created > Oath, Bond 124 3. The remaining provisions of the Canton Municipal Code shall remain in full force and effect,unchanged by the foregoing repeal. 4. All ordinances or parts thereof in conflict with this Ordinance are hereby expressly repealed. 5. If any part or parts of this Ordinance shall be held to be unconstitutional or otherwise invalid, such unconstitutionality or invalidity shall not affect the validity of the remaining provisions of this Ordinance. 6. This Ordinance shall be in full force and effect from and after its passage and approval as provided by law and thereafter shall be effective December 1, 2021.
