DATED AT CANTON, ILLINOIS, THIS DAY MT MBER 2021 Diana Pavley- ock, CMC, i y Jerk Seal City of Canton, Illinois ORDINANCE NO. 4256 AN ORDINANCE AMENDING TITLE 6, CHAPTER 12 (WEAPONS AND FIREARM REGULATIONS) OF THE CANTON MUNICIPAL CODE WHEREAS, the City of Canton, Fulton County, Illinois (the "City") is an Illinois non- home rule municipal corporation, established in accordance with the constitution of the State of Illinois of 1970; WHEREAS, Title 6, Chapter 12 of the Canton Municipal Code (the "Code") contains provisions related to the regulation of weapons and firearms within the City; WHEREAS, the City already has or intends to annex territories where educational activities are provided related to archery and/or firearms; WHEREAS, based upon the current ordinances of the City of Canton, upon annexation, said activities would effectively be or are banned in said rural areas due to being within the corporate limits of the City; WHEREAS, the Council of the City of Canton has determined that it is necessary and in the best interest of the City to amend and update Title 6,Chapter 12 of the Code in order to provide for said educational opportunities, as well as other school-sponsored extracurricular or philanthropic activities. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, FULTON COUNTY, ILLINOIS AS FOLLOWS: Section 1. That the City hereby finds as fact the recitals set forth above and incorporates said recitals herein as though fully set forth. Section 2. That Section 6-12-9 of the Canton Municipal Code is hereby added to Title 6, Chapter 12, and said Section shall state as follows: 6-12-9: EDUCATIONAL, SCHOOL-SPONSORED EXTRACURRICULAR AND/OR PHILANTHROPIC ACTIVITY EXCEPTION: Sections 6-12-2, 6-12-3, and 6-12-4 of this Chapter shall not apply to individuals while they are actively involved in activities hosted by not-for-profit organizations or educational institutions, for educational, school-sponsored extracurricular, or philanthropic purposes only, and involving the shooting of targets or practicing archery skills, provided the weapons/firearms used, activities and location of the shooting of targets and/or archery skills are first approved in writing by the Chief of Police. The carrying or transportation of any firearms or weapons to and from said approved educational, school-sponsored extracurricular,or philanthropic activities,or discharge of any weapons or firearms outside of said activities, must otherwise comply with this Municipal Code and/or any other applicable laws or regulations. Section 3. That all ordinances or parts thereof in conflict with this Ordinance are hereby expressly repealed. 1 Section 4. If any part or parts of this Ordinance shall be held to be unconstitutional or otherwise invalid, such unconstitutionality or invalidity shall not affect the validity of the remaining provisions of this Ordinance. Section 5. That this Ordinance shall be in full force and effect from and after its passage and approval as provided by law. PASSED THIS 7th day of September, 2021.
