A RESOLUTION APPROVING A WAIVER OF SEPTIC TANK SETBACK RELATIVE TO LOTS #17
AND #18, EXCEPTING 10 FEET OF EVEN WIDTH OFF THE EAST SIDE OF LOT 18, OF
DAL-BAR SUBDIVISION, A PART OF THE SOUTHEAST QUARTER OF SECTION 19, TOWNSHIP
7 NORTH, RANGE 5 EAST OF THE FOURTH PRINCIPAL MERIDIAN, FULTON COUPJTY, ILLINOIS,
WHEREAS, the City Council of the City of Canton, Illinois has determined
that it is desirable and in the best interest of the City of Canton, Illinois
that the instant waiver of septic tank setback, hereto attached as Exhibit A,
be approved by the City Council of the City of Canton, Illinois and executed
by the Mayor and City Clerk.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CANTON,
ILLINOIS, AS FOLLOWS:
1. That the waiver of septic tank setback hereto attached as Exhibit A
and which is herein incorporated by reference, is hereby approved.
2. That the Mayor and the City Clerk of the City of Canton, Illinois
are hereby authorized and directed to execute said agreement on behalf of the
City of Canton.
3. That this Resolution shall be in full force and effect upon its
passage by the City Council of the City of Canton, Illinois and approval by
the Mayor thereof.

WAIVER OF SEPTIC TANK SETBACK
The undersigned, as the owner of property abutting and adjacent to
Lots 17 and 18, except 10 feet of even width off the East side of said
Lot 18 of Dal-Bar Subdivision, a part of the Southeast Quarter of Section
19, Township 7 North, Range 5 East of the Fourth Principal Meridian,
Fulton County, Illinois, for good and valuable consideration do hereby
waive any right which the undersigned may have to require the owner
of Lots 17 and 18 except the East ten feet of even width of said Lot 18
to install the septic tank and field no closer than ten feet from the
lot line and do hereby affirmatively agree that said septic tank and
field may be installed closer than said ten feet to the lot line but
in no case to cross the lot line or encroach upon the lands of the
undersigned adjacent to said lots. It is the intent of this document
to allow the owner of Lots 17 and 18 except the East ten feet of Lot 18,
to install a septic tank and field up to the lot line in order to
utilize said property.
This agreement may be recorded and it is intended to run with the
land and be binding upon subsequent owners of said tracts. Further, that
this waiver shall be null and void and of no force and effect unless the
contemplated septic tank installation is completed within 180 days of the
date of execution hereof.
IN WITNESS WHEREOF, the Owner has executed this document at Canton,
