RESOLUTION NO. 3729
A RESOLUTION RESCINDING RESOLUTION NO. 1326 INVOLVING
SPECIFIC SALARIES FOR VARIOUS EMPLOYEES OF THE CITY OF
CANTON
WHEREAS, on April 19, 2005 the City Council of the City of Canton on a vote
by alderman of 5 aye, 3 nay with Mayor Bohler also voting aye passed Resolution No.
1326 APPROVING SPECIFIC SALARIES FOR THE VARIOUS DEPARTMENT
HEADS, SUPERINTENDENTS, FULL TIME APPOINTIVE EMPLOYEES AND ,_
PART TIME APPOINTIVE EMPLOYEES OF THE CITY OF CANTON.
WHEREAS, said Resolution inferentially amends Ordinance No. 1804 of July 7,
2004 establishing salaries for city employees, and
WHEREAS, matters having permanent effect on the finances of a municipality
must be considered by Ordinance and not Resolution, and
WHEREAS, an Ordinance legally may not be amended by Resolution, and
WHEREAS, no appropriation ordinance nor budget has been adopted for the
fiscal year beginning May 1, 2005, and
WHEREAS, pursuant to Illinois statutes, salaries for municipal employees may
be fixed by the annual appropriation ordinance or by budget ordinance (65 ILCS 5/3.1-
50-10).
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF CANTON, Fulton County, Illinois as follows:
1. Resolution 1326 dated April 19, 2005 be and the same is hereby rescinded and
held for naught.
2. Ordinance 1804 of July 7, 2004 shall remain in full force and effect until a new
appropriation ordinance or budget ordinance is enacted.

3. That this Resolution shall be in full force and effect immediately upon its passage
by the City Council of the City of Canton, Illinois.
