ORDINANCE NO. 4253
AN ORDINANCE ANNEXING LAKE CANTON
WHEREAS, the City of Canton, Fulton County, Illinois (the "City") is an Illinois non-
home rule municipal corporation, established in accordance with the Constitution of the State of
Illinois of 1970;
WHEREAS, Section 7-1-9 of the Illinois Municipal Code (65 ILCS 5/7-1-9)provides:
Whenever any contiguous, uninhabited, unincorporated territory is owned by any
municipality, that territory may be annexed by that municipality by the passage of an
ordinance to that effect, describing the territory to be annexed. A copy of the ordinance,
with an accurate map of the annexed territory shall be recorded with the recorder of the
county wherein the annexed territory is located and a document of annexation shall be filed
with the county clerk and County Election Authority.
WHEREAS, the City the owner of certain territory, legally described as set forth in
"Exhibit A" (hereinafter the"Property");
WHEREAS,the Property is contiguous to the City, uninhabited, and unincorporated;
WHEREAS, as of the time of this Ordinance, no electors reside on the Property;
WHEREAS, an accurate map of the Property is attached hereto as "Exhibit B";
WHEREAS,pursuant to 65 ILCS 5/7-1-1, the Trustees of all Fire Protection Districts and
Public Library Districts have been notified by certified or registered mail, at least ten(10) days in
advance of the regular meeting of the City of Canton City Council on June 1, 2021, that action
may be taken at said meeting to annex the Property;
WHEREAS, pursuant to 65 ILCS 5/7-1-1, all applicable Township Commissioners of
Highways, Board of Town Trustees, Township Supervisors, and Township Clerks have been
notified by certified or registered mail, at least ten (10) days in advance of the regular meeting of
the City of Canton City Council on June 1,2021,that action may be taken at said meeting to annex
the Property;
WHEREAS,the Committee on Lake, Buildings and Grounds and the City Council of the
City of Canton have determined that it is necessary and in the best interest of City to annex the
Property and expand the corporate limits of the City of Canton, Illinois.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CANTON, FULTON COUNTY, ILLINOIS AS FOLLOWS:
1. The City hereby finds as fact the recitals set forth above and are incorporated herein as
though fully set forth;
2. The Property is hereby annexed to the City of Canton, Illinois;
3. The City Clerk is hereby directed to record a certified copy of this Ordinance with the
Recorder of Fulton County, Illinois, as well as a separate copy of Exhibit B;
4. The City Attorney shall cause a Notice of Annexation to be filed or otherwise sent to the
Fulton County Clerk, Fulton County's Election Authority, and the United States Postal
Service;
5. The City Treasurer is directed to pay all recording or filing fees necessary to accomplish
the foregoing; and
6. This Ordinance shall be in full force and effective immediately upon its passage by the City
Council of the City of Canton and approval by the Mayor.
