HomeMy WebLinkAboutResolution # 3723~. c RESOLUTION NO. 3723 A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF CANTON AND KINNE, WALDROP, et al. WHEREAS, the City Council of the City of Canton, Fulton County, Illinois, reviewed the terms of the Agreement, a copy of which is attached hereto and made a part hereof as Exhibit A; and WHEREAS, the City Council of the City of Canton, Illinois, has determined that it is in the best interest of the City of Canton to approve said Agreement. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. That the Agreement which is attached hereto and made a part hereof as Exhibit A, is hereby approved, said Agreement to be subject to and effective pursuant to the terms and conditions set forth therein. 2. That the Mayor of the City of Canton, Illinois, is hereby authorized and directed to execute and deliver said Agreement on behalf of the City of Canton. 3. That this Resolution shall be in full force and effect immediately upon its passage by the County Board of Fulton County, Illinois and approval by the Mayor thereof. APPROVED: ~- Attest: Nancy Wl tes, City Clerk AGREEMENT FOR SPECIAL TAP FEES This agreement is made at Canton, Illinois on the date shown at the end hereof and is by and between the City of Canton, an Illinois municipal corporation ("City") and Byron Kinne, Amanda Kinne, Joel Waldrop and Lynne Waldrop and sets forth the understanding of the parties pertaining to tap on fees for the extension of a water line. Whereas, Byron Kinne, Amanda Kinne, Joel Waldrop and Lynne Waldrop have privately caused an extension to be made of a water line from the intersection of E. Middle Lake Road and N. Venovich Road to their residences and the line was financed in whole by Byron Kinne, Amanda Kinne, Joel Waldrop and Lynne Waldrop at a cost of $16,000 as shown on Exhibit A hereto; and Whereas, the City Council has agreed to waive the requirement of Section 8-21-1 of the Canton Municipal Code that a written agreement shall be in existence and in the City's files before any construction starts; NOW, THEREFORE, it is agreed that hereafter, any person or entity desiring to connect to said water line herein described before connecting shall pay to the City a tappage fee in addition to the normal tappage fee based upon the $16,000 in costs incurred by Byron Kinne, Amanda Kinne, Joel Waldrop and Lynne Waldrop to construct the line before fmancial assistance from the City. Payments shall be made at the City Treasurer for reimbursement as hereafter provided. This agreement shall be for a period often (10) years from the issuance of the Illinois E.P.A. pen~nit for the line. Reimbursement shall be calculated as follows: the first person to tap on in addition to Waldrop and Kinne shall pay 16,000 divided by 3 or $5,333.33. The money so received shall be paid to Byron Kinne and Amanda Kinne. When the next investor wishes to tap on, he shall $16,000 divided by 4 or $4,000. This sum shall then be divided amongst the (3) earlier investors so that if all properties in the area are sold, each will share equally in the extension cost. Each year the principal amount shall be adjusted by the Consumer Price Index (CPI). All Consumer Price Index increases shall go to the City for maintenance and administration.
