HomeMy WebLinkAboutOrdinance # 18431 `~ ~ 1 ~ ORDINANCE NO. 184:1 An Ordinance re-zoning certain property of Petersen Companies LLC, a Limited Liability Company in a B-2 zoning configuration. WHEREAS, the property described on Exhibit A, which is attached hereto and made a part hereof ("Petersen Property', is located within the corporate limits of the City of Canton, Fulton County, Illinois; and WHEREAS, the Petersen Property is currently zoned R-2, single family, under the Canton City Code; and WHEREAS, Petersen Companies LLC, is the owner of the Petersen Property and has petitioned the City Council of the City of Canton, Illinois that the property be re- zoned to a B-2 zoning configuration in order to accommodate the construction of a commercial retail, dining/ice cream establishment; and WHEREAS, the surrounding neighborhood consists of a mixture of commercial and residential uses and the re-zoning of the Petersen Property would be consistent with the mixed uses in the area; and WHEREAS, on July 11, 2005, the Planning & Zoning Commission of the City of Canton met, pursuant to notice as required by law, and held a public hearing concerning the Petitioner's request to re-zone the Petersen Property in a B-2 zoning 1 MSW-REAL ESTATE Petersen Companies Ordinance Sb7.12.05 a t' configuration and at said meeting, there were no objectors present and the Planning & Zoning Commission unanimously recommended to the City Council of the City of Canton, Illinois, the re-zoning of the Petersen Property to a B-2 zoning configuration; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, ILLINOIS, A MUNICIPAL CORPORATION: 1. That the property described on Exhibit A and known as the Petersen Property shall be and the same is hereby re-zoned to a B-2 zoning configuration. 3. That the corporate authorities of the City of Canton, Illinois, and their respective officers and agents shall be and they are hereby authorized to amend the zoning maps of the City of Canton, Illinois, to so reflect the re-zoning of the Petersen Property to a B-2 zoning configuration. 4. That a copy of this Ordinance shall be filed with the appropriate authorities of the County of Fulton and State of Illinois, to reflect the rezoning of the Petersen Property, all as made and provided for by law. 5. Because I was not notified in person or in writing of the public hearing, nor aware of the notice that appeared in the newspaper on June 23, I was not present at the hearing on July 11. Even if I had read the notice in the newspaper, I would not have known that the property listed as 806 North Main was, in fact, the Hosslers' home. The Hosslers' driveway is situated on West Birch, and the mailbox faces West Birch; therefore, I assumed that property had a West Birch address. If I had had the correct information about the property, I would have been there on July 11 to voice my fears and concerns. Because of this confusion and misunderstanding of where the property was located, I am now asking you to reconsider the rezoning of 806 North Main. I have talked to many residents in the surrounding area about this rezoning. Most of the people to whom I spoke did not know where the property on 806 North Main was located. When they finally understood that 806 North Main was that big white house on West Birch, they were astonished to find out that the property had been sold. Then, when I informed them that the property was scheduled to be rezoned from residential to business, they were extremely upset and concerned. Due to this response from the residents, I have started a petition to stop the rezoning. I will also be speaking at the City Council meeting on August 2 to voice our fears and concerns about this rezoning. After talking to the neighborhood, our main fears and concerns are as follows: If a new business were located on 806 North Main, the only feasible entrance and exit would have to be located on West Birch. This entrance and exit would create a very hazardous traffic situation not only for other vehicles but also for all the residents...especiallythe children. Our neighborhood has over 30 children in the area. This increase in traffic would be a grave danger to our children and forever change the peaceful and quiet lifestyle that we all now enjoy. We are also very anxious about the environmental effects that this rezoning will have on the residents in the area. We are concerned about the level of noise, the issue of air pollution from the vehicles, and the effects of bright lighting on the neighborhood. We are also bothered about the issue of trash. This large volume of trash can cause problems from odor to an increase in rodents in the area. Finally, we are afraid that our property values will go down and our taxes will go up. Please take into consideration the above issues of concern when you make your final decision on the rezoning issue on Aug 2. 1 am praying for a no vote on this rezoning, but if this is not possible, please send this rezoning issue back to the Planning and Zoning Committee for further study. On Monday, July 11, 2005, the Planning & Zoning Commission unanimously recommended the rezoning. I understand this will be on the Council's agenda for Tuesday, July 19, 2005, for a first reading and that no action will be taken. We will not plan to attend the Council Meeting at that time. I understand the matter will be presented for a vote on Tuesday, August 2, 2005, at the regular Council session. If I am mistaken in any manner, then please advise me as soon as possible.
