HomeMy WebLinkAboutResolution #0976~ ,~ RESOLUTION NO. 976 A RESOLUTION CONDITIONALLY ACCEPTING A TRUSTEE'S DEED CONVEYING THE SCRIPPS BUILDING TO THE CITY OF CANTON WHEREAS, the owners of the Scripps Building have offered to give such building and real property to the City of Canton; and, WHEREAS, the City of Canton has heretofore conditionally agreed to the proposed gift; and, WHEREAS, the donors of such real property have delivered their deed of conveyance to the City of Canton; and, WHEREAS, the City of Canton has not been presented with an updated abstract of title or other evidence of title. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois as follows: 1. That the deed of conveyance heretofore delivered to the City of Canton, a copy of which is hereto attached and identified as Exhibit A, is hereby conditionally accepted by the City of Canton. 2. That acceptance of said deed, Exhibit A hereto, is specifically made upon the following conditions: a. That examination of status of title to the real property described in Exhibit A shows title to be free of all liens, encumber- ances and clouds on title of whatsoever nature; b. That any conditions, easements, covenants and restrictions of record be compatable with the City of Canton's Redevelopment Plan and Redevelopment Project as the same may be amended. 3. That, in the event that examination of status of title shall not be in accord with this conditioned acceptance, such acceptance shall be deemed to be null and void for every and all purposes. 4. That, subject to the foregoing, this Resolution shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois and approval by the Mayor thereof. 5. That subsequent approval of the status of title by the City Attorney shall, for all purposes and uses, relate back to and be effective as of the date hereof. PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular meeting this 21st day of December 1982, upon a roll call vote as follows: AYES: Aldermen Hammond, Savill, Sarff, Grant, Carl, Larsen, Horr. TRUSTEE'S DEED THIS INDENTURE, made this 1~~ tl~ day of /~L~ ~,',;~~ ~~~~/ , 1982, between COMMUNITY BANK & TRUST COMPANY, an Illinois Banking Association as Trustee under the provisions of a Trust Agreement dated February 4, 1977 designated as Trust No. 21-214, GRANTOR, and the CITY OF CANTON, an Illinois municipal corporation, GRANTEE. WITNESSETH, that the Grantor in performance of said trust and premised upon good and valuable considerations, the receipt and sufficiency of which is hereby acknowledged, does hereby convey to the Grantee the following described real estate, to-wit: A part of Lot Number Nine (9) in Jones' First Addition to the City of Canton, Fulton County, Illinois, described as follows: Begining at the Northwest corner of the aforesaid Lot #9, running thence East 181-~ feet; thence, South 60 feet; thence, West 101-; feet; thence, North 10 feet; thence, West 80 feet; thence, North 50 feet to the place of begining. Also any and all right, title and interest in and to those portions of White Court and Chestnut Street that may have accrued to the benefit of Grantor by reason of street vacations by the City of Canton, (elso subject to all easements, covenants and restrictions of record. together with the tenements and appurtenances thereto belonging and the rents, income, issues and profits thereof, and all of the estate, right, title and interest, whatsoever, at law or in equity of the Grantor in and to said premises, subject, however, to the requirements of the City of Canton's Re- development Plan and Redevelopment Project, as the same may be hereafter amended.
