A RESOLUTION GRANTING AN EXTENSION OF TIME TO BAR-V-ENTERPRISES
FOR COMPLETION OF CERTAIN IMPROVEMENTS SET FORTH IN AGREEMENT #428
WHEREAS, the City of Canton and BAR-V-Enterprises entered into
a certain written agreement on or about September 7, 1982, such
agreement being denoted "Agreement #428,"; and,
WHEREAS, Section 4 of said Agreement require the completion of
certain improvements to the real property and improvements thereon
therein described by a date certain; and,
WHEREAS, circumstances beyond the control of BAR-V-Enterprises
have made compliance with Section 4 of said Agreement impossible
of compliance by such date.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CANTON, Fulton County, Illinois as follows:
1. That the deadline of January 1, 1983 established in Section 4
of Agreement #428, as the same relates to the completion of certain
improvements therein set forth, be, and the same hereby is, extended
to date of June 1, 1983.
2. That this extension and Resolution shall be retroactive to date
of December 31, 1982.
3. That this Resolution shall be in full force and effect
immediately upon its passage by the City Council of the City of
Canton, Fulton County, Illinois and approval by the Mayor thereof.
PASSED by the City Council of the City of Canton, Fulton County,
Illinois at a regular meeting this 18th day of January
1983 upon a roll call vote as follows:
AYES: Alderman Kovachevich, Savill, Sarff, Grant, Carl, Larsen, Horr.
NAYS: None.
ABSENT: Alderman Hammond.
