RESOLUTION AUTHORIZING JOINT ACQUISITION
AND OPERATION OF WATERWORKS SYSTEM
AND/OR COMMON SOURCE OF SUPPLY OF WATER
WHEREAS, the City of Canton is authorized by the Illinois
Municipal Code, Illinois Revised Statutes, Chapter 24,
Section 11-135-1, to adopt a resolution determining and
electing to acquire and operate jointly a waterworks system
or a common source of supply of water or both, as the case
may be, with one or more other municipalities; and
WHEREAS, a freshwater lake of approximately 13,000
acres has been proposed for the west central Illinois area
which would benefit the City of Canton and other area com-
munities; and
WHEREAS, the City of Canton desires to avail itself of
the provisions of Illinois Revised Statutes, Chapter 24,
Section 11-135-1, and thereby form a part of the water
commission to be established under such statutory provisions;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
CANTON, ILLINOIS:
1. That the City of Canton hereby determines and
elects pursuant to the provisions of Illinois Revised Statutes,
Chapter 24, Section 11-135-1 to acquire and operate jointly
a waterworks system or a common source of supply of water,
or both, as the case may be, as part of the water commission
to be formed by the adoption of this resolution by the City
of Canton and the adoption of similar resolutions by one or
more other municipalities, such water commission to be known
as the West Central Illinois Water Commission.
2. That the Mayor, City of Canton, is hereby, pursuant to
authority of Section 11-135-1, Chapter 24, Ill. Rev. Stat. 1983,
authorized and directed, upon adoption and approval of this Resolution,
to appoint a commissioner to serve on the West Central Illinois Water
Commission, subject to approval by the City Council.
3. That the City Clerk is hereby directed to certify a copy
of this Resolution to the West Central Illinois Water Commission
immediately upon its passage and approval.
4. That this Resolution is not intended by the Canton City
Council to obligate the City of Canton to financial participation in
the West Central Illinois Water Commission; accordingly, nothing con-
tained in this Resolution shall ever be construed to obligate the City
of Canton to financial participation or obligation in or to the West
Central Illinois Water Commission unless the City of Canton takes sub-
sequent and specific action by Ordinance creating such financial
participation or obligation.
5. That this Resolution shall be in full force and effect
immediately upon its passage by the City Council of the City of Canton,
Fulton County, Illinois, and approval by the Mayor thereof.
