A RESOLUTION RELATING TO BAR-V-ENTERPRISES AND DIRECTING THE
MAYOR AND CITY CLERK TO EXECUTE AND DELIVER TO BAR-V-ENTERPRISES
T#iE CITY'S RELEASE OF CERTAIN COVENANTS RUNNING WITH THE LAND
AS SET FORTH IN AGREEMENT NUMBER 428.
WHEREAS, the City of Canton has previously made a conditional
conveyance of certain real property to BAR-V-Enterprises, all as
more fully set forth in one certain Warranty Deed filed of record
as Instrument Number 83-3527 of Fulton County Land Records, and,
as more fully set forth in Agreement Number 428; and,
WHEREAS, BAR-V-Enterprises has met all of said conditions prior
to the date for full performance by BAR-V-Enterprises; and,
WHEREAS, the City of Canton deems it necessary and in the best
interest of the City of Canton that said conveyance now be made
free and clear of all such conditions and covenants.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CANTON, Fulton County, Illinois as follows:
1. That the foregoing recitals are hereby found to be fact.
2. That the Mayor and City Clerk are hereby authorized and
directed to execute and deliver to BAR-V-Enterprises the full
release of all conditions and covenants running with the land
contained in one certain warranty deed from the City of Canton
to BAR-V-Enterprises which deed is dated September 21, 1982,
and which was filed of record with the Fulton County Recorder
on September 7, 1983 in Volume 935 of records at page 301 as
Instrument I~'umber 83-3527.
3. That this Resolution shall be in full force and effect
immediately upon its passage by the Canton City Council and
the approval of the Mayor, City of Canton.
PASSED by the City Council of the City of Canton, Fulton
County, Illinois at a regular meeting this 17th day of
September 1985 upon a roll call vote as follows:
AYES: Aldermen Kovachevlch, Zilly, Falcone, Sarff, Workman,
Bohler, May, Chapman.
NAYS: None.
ABSENT: None.
