HomeMy WebLinkAboutResolution #1115RESOLUTION N0. 1115 A RESOLUTION APPROVING A "LETTER OF UNDERSTANDING" BETWEEN THE CITY OF CANTON AND THE ILLINOIS DEPARTMENT OF TRANSPORTATION AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER SAID LETTER. WHEREAS, the Canton City Council has determined that it is necessary and in the best interest of the City of Canton to enter into a letter of understanding with the Illinois Department of Transportation hereto attached and herein incorpor- ated as Exhibit "A". NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. That the letter of understanding hereto attached as Exhibit "A" between the City of Canton and the Illinois Department of Transportation is hereby approved. 2. That the Mayor and the City Clerk are hereby authorized and directed to execute and deliver said agreement on behalf of the City of Canton. 3. That this Resolution shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois, and approval by the Mayor thereof. PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular meeting this 6th day of November 1985 upon a roll call vote as follows: AYES: Aldermen Kovachevich, Zilly, Falcone, Sarff, Workman, Bohler, May, Chapman. Edwards Mayor of the City of Canton City Ha11 Canton, IL 61520 Dear Mayor Edwards: The Department of Transportation is proposing a highway improve- ment on Illinois Route 9 (Linn Street) from Illinois Route 78 (Fifth Avenue) in Canton to U.S. Route 24 in Banner. Within the Canton city limits, we are proposing the following: 1. Widen the existing 24' wide pavement to 42' to provide two through traffic lanes and a center bi-directional turn lane for approximately 700' on Illinois Route 9 east of the Illinois Route 78 intersection. 2. Construct a bituminous overlay and also a 10' bituminous shoulder along the remainder of Illinois Route 9 in Canton. 3. Replace the 400+' of existing storm sewer along the south side of Illinois Route 9. 4. Replace any existing curb, gutter, and sidewalk that is removed as a result of this improvement. 5. Improve the northeast and southeast quadrants of the Illinois Route 9-Illinois Route 78 intersection to accommodate three lanes and provide the appropriate truck-turning radii. 6. Acquire, by our office in the name of the State, the property and building in the northeast quadrant of the Illinois Route 9-Illinois Route 78 intersection, and also a small portion from the gas station in the southeast quadrant of the same intersection. The Honorable Donald E. Edwards City of Canton October 30, 1985 Page 2 This improvement is to be constructed under traffic and we do not foresee a need to close any city streets. Local property owners will be provided access at all times. Upon completion of the improvement, the Department of Trans- portation will maintain the center bi-directional turn lane, the two through traffic lanes, the right-turn lanes, and the curb and gutter adjacent to those traffic lanes. We expect the City to assume the maintenance of all portions which are not maintained by the Department of Transportation, including all curbs and gutter flags not maintained by the State, manholes, catch basins, storm sewers, utilities, sidewalks, and appurte- nances. Your approval of this Letter of Understanding will be considered acceptance of these maintenance provisions. Previous discussions with City officials have indicated that you are not interested at this time in adding any items to our contract which would be of interest to the City. As a result, the improvement will not include any new street lighting, additional sidewalks, parking lanes, or other related items; and the Department of Transportation will assume the entire cost of the improvement. We will, however, expect the City to pass ordinances to prohibit parking along the route, to control discharge of sanitary sewage into new storm sewers constructed within the improvement, and to effect and control the disposition of encroachments along the route. We expect the City to provide us with a resolution or letter approving the plans and specifications for the portions of the pro3ect which will be under their maintenance responsibility. We also expect the City to exercise its franchise right to cause private utilities to be relocated at no expense to the State, and ask the City not to permit any driveway entrance openings to be made in the curb as constructed without first obtaining our consent. I have attached copies of sample ordinances which you may wish to use as a guide. Copies of the adopted ordinances, as mentioned above, will need to be in our files prior to our recommending construction of this improvement. The plans and specifications will be forwarded as soon as they are available for your inspection and use, together with a request for your approval. The Honorable Donald E. I ask that you sign both copies and return one copy with your original signature to me by December 6, 1985. Upon receipt of this copy, we will assume that you agree to all terms stated herein.
