HomeMy WebLinkAboutOrdinance #0852t ~' ORDINANCE N0. ~~a AN ORDINANCE AMENDING CERTAIN SECTIONS OF TITLE 6, CHAPTER 6 OF THE CANTON MUNICIPAL CODE CONCERNING DUTCH ELM DISEASE. WHEREAS, the Legal & Ordinance Committee of the City of Canton, Illinois has determined that it is necessary, desirable and to the best interest of the City of Canton to modify and amend certain sections of Title 6, Chapter 6 of the Canton Municipal Code concerning Dutch Elm Disease; and WHEREAS, the City Council of the City of Canton, Illinois has made a similar determination. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, ILLINOIS, AS FOLLOWS: 1. That Title 6, Chapter 6, Section 1 of the Canton Municipal Code be, and the same is hereby amended to read as follows: "6-6-1: NUISANCE DECLARED: Any tree or part thereof, whether living or dead, infected with or attacked by ceratocystis ulmi (the Dutch Elm disease), or any other disease or parasite, and any tree which has become hazardous to life or property because of age or neglect of the owner thereof, is hereby declared to be a nuisance, and it shall be unlawful to permit any such tree or part thereof to remain in the City." 2. That Title 6, Chapter 6, Section 2 of the Canton Municipal Code be, and the same is hereby amended to read as follows: "6-6-2: INSPECTION: The Director of Public Works or some other person desig- nated by him are hereby authorized to inspect and examine any tree in the City, to determine whether or not it is infected by the Dutch Elm disease, or is in a hazardous condition, as in this Chapter set forth. Upon discovering that any such tree is so infected or is in a hazardous condition, as aforesaid, the owner or occupant of the premises shall be notified of this fact." -1- i s- ~ T 3. That Title 6, Chapter 6, Section 4 of the Canton Municipal Code be, and the same is hereby amended to read as follows: "6-6-4: CITY, ABATEMENT: Where the owner or occupant of the premises concerned does not properly dispose of such infected or hazardous tree, as herein set forth, after such notice, or where the owner or occupant cannot be located, the Director of Public Works, or any other person designated by him, are hereby authorized to remove and destroy such tree or trees, engaging such services from the City and its employees as may be necessary to prop- erly remove and destroy such tree or trees, at the expense of the party or parties permitting same." 4. That Title 6, Chapter 6, Section 5 of the Canton Municipal Code be, and the same is hereby amended to read as follows: "6-6-5: PENALTY: Any person violating any provisions of this Chapter shall be fined not less than twenty-five dollars ($25.00) nor more than five hundred dollars (.$500.00) for each offense; and a separate offense shall be deemed committed on each day a diseased or infected tree or hazardous tree or any portion thereof remains on the premises more than thirty (30) days after notice has been given in accordance with the provisions of this Chapter." 5. That the remainder of Title 6, Chapter 6, Dutch Elm Disease, of the Canton Municipal Code remain in full force and effect. 6. That this ordinance shall be in full force and effect upon its passage by the City Council of the City of Canton, Illinois and approval by the Mayor thereof.
