WHEREAS, the Legal & Ordinance Committee of the City of Canton, Illinois has determined that it is necessary, desirable and to the best interests of the City of Canton to modify and amend Title 6, Chapter 5 of the Canton Municipal Code concerning dogs; and WHEREAS, the City Council of the City of Canton, Illinois has made a similar determination. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, ILLTNOIS, AS FOLLOWS: 1. That Title 6, Chapter 5 of the Canton Municipal Code be, and the same is hereby amended to read as follows: CHAPTER 5 DOGS AND CATS SECTION: 6-5- 1: Definitions 6-5- 2: License Requirements 6-5- 3: Tag, Register 6-5- 4: Tag on Collar 6-5- 5: When Officers May Kill Dog or Cat 6-5- 6: Dogs and Cats to be Restrained 6-5- 7: Prohibited at Public Places 6-5- 8: Dogs and Cats in Heat 6-5- 9: Dogs and Cats on Streets in Business Area 6-5-10: Inoculation 6-5-11: Impounding 6-5-12: Person Bitten by Dog or Cat 6-5-13: Exceptions 6-5-14: Penalty 6-5-1: DEFINITIONS: The following words or phrases when used in this Chapter shall have for the purposes of this Chapter the meanings respectively ascribed to them in this Section, except when the context otherwise requires: DOG means a domesticated carnivore, scientifically known as cants familiaries, of whatever breed, sex or variety. CAT means a small domesticated quadruped carnivore, of the family of felines, of whatever breed, sex or variety. OWNER means any person having a right of property in a dog or cat, or who keeps or harbors a dog or cat, or has a dog or cat in his care, or acts as its custodian, or who knowingly permits a dog or cat to remain on or about any premises occupied by him. -1- DOG IN HEAT or IN HEAT means that period or duration of time when there is sexual excitement in a female dog. CAT IN HEAT or IN HEAT means that period or duration of time when there is sexual excitement in a female cat. SPAY or SPAYED DOG means a female dog which has had her ovaries removed. SPAY or SPAYED CAT means a female cat which has had her ovaries removed. INOCULATION AGAINST RABIES means the injection, subcutaneously or otherwise, as approved by the Department of Agriculture of the State of Illinois, of anti-rabic vaccine approved by said Department. RABIES INSPECTOR means the Rabies Inspector appointed pursuant to the laws of the State of Illinois. RESTRAINT means a dog or cat, off the premises of its owner's real property is under restraint within the meaning of this Chapter: (A) If it is controlled by a line or leash not more than six feet (6') in length, when said line or leash is held by a competent person; (B) When within a vehicle; (C) When not more than fifty feet (50') from a competent person, if such dog or cat is not annoying or worrying any person or domestic animal, or trespassing on private property. COMPETENT PERSON means a human being who is capable of controlling the dog or cat in question, and to whose commands the dog or cat is obedient. BUSINESS DISTRICT means that portion of the City where fifty percent (50%) or more of the buildings in one block are used for business purposes. 6-5-2: LICENSE REQUIREMENTS: Every owner of a dog or cat shall register the same with the City Clerk and obtain a license for each dog and cat from the Clerk prior to June 1 of each year. The fee for each license shall be two dollars ($2.00) payable when applying for said license. When making such application, the owner shall present to the Clerk a certificate of inoculation as required by laws of the State of Illinois. 6-5-3: TAG, REGISTER: Each dog license and each cat license shall be evidenced by a small metal tag which shall be issued to the licensee by the Clerk for each dog licensed and. for each cat licensed to the owner thereof upon proper application for registration and license as aforesaid and upon presentation to the Clerk of such certifi- cate of inoculation as hereinbefore provided. Each of said tags shall bear the words "Canton Dog Tag" or "Canton Cat Tag" stamped thereon, as well as the number of the license and the year of issuance. The shape of the tags shall be changed each year. -2- The City Clerk shall keep a register book in which she shall list all licensed dogs and all licensed cats, describing them by name, breed, color and sex and also enter therein the name and address of the licensee as given and the number of the license tag. 6-5-4: TAG ON COLLAR: Every owner of a dog and every owner of a cat shall keep and maintain a collar or harness around the dog or cat with the tag issued by the Clerk pursuant to this Chapter and a rabies inoculation tag securely attached to said collar or harness. 6-5-5: WHEN D`FFICERS MAY KILL DOG OR CAT: It shall be unlawful for any person to hinder, delay, resist or obstruct any duly appointed officer in the execution of his duties herein required by this Chaper, or to aid or abet in the hindering, delaying, resist- ing or obstructing such officer; and if any dog or cat shall become vicious or offer to bite or bite any duly appointed officer while performing his duties herein required of him, such officer shall immed- iately kill said dog or cat and dispose of it as required by law. 6-5-6: DOGS AND CATS TO BE RESTRAINED: It is unlawful for any owner or keeper of a dog or cat to permit such dog or cat to be off the premises of its owner unless it is under restraint by a competent person as defined by Section 6-5-1 hereof, unless said dog or cat is upon peoperty of another with that property owner's consent. 6-5-7: PROHIBITED AT PUBLIC PLACES: It is unlawful for any owner or keeper of a dog or cat to permit such dog or cat to be upon school or play grounds in the City. 6-5-8: DOGS AND CATS IN HEAT: A female dog which has not been spayed and when in heat shall be confined by her owner in an enclosed place so that male dogs cannot enter such place. A female cat which has not been spayed and when in heat shall be con- fined by her owner in an enclosed place so that male cats cannot enter such place. 6-5-9: DOGS AND CATS ON STREETS IN BUSYNESS AREA: It shall be unlawful for any person to have a dog or cat on the public streets and sidewalks of a business area or Jones Park in the City, unless said dog or cat is on a leash in the custody of a competent person as provided for in Section 6-5-1 hereof, or in a vehicle. 6-5-10: INOCULATION: Every dog and cat which is not confined shall annually be inoculated by a licensed veterinarian as required by the laws of the State of Illinois. 6-5-11: IMPOUNDING: It shall be the duty of the Police Department or any person duly appointed by the Mayor and confirmed by the Council to act as such, to capture any dog or cat whose owner has violated or failed to comply with any of the provisions of this Chapter. Any dog or cat so captured shall be immediately transferred to a pound which has been approved by the proper authorities of the State of Illinois. The impounding officer shall immediately notify any licensee of any dog or cat bearing a license tag issued by the Clerk for the year in which the dog or cat is captured after finding the name and address of the licensee from the Clerk. Notice also shall be posted in the City Building located at 210 East Chestnut Street, and the Police Station located at 101 East Spruce Street, which notice shall describe the breed and color of the dog or cat. If within five (5) days after the posting of such notice any dog or cat is not redeemed, such dog or cat shall be humanely destroyed and disposed of. -3- Any person redeeming dollars ($3.00) plus that the said dog or that any dog or cat of Section 6-5-10 of or cat inoculated. any dog or cat shall pay the sum of three the sum of one dollar ($1.00) for each day cat has been impounded; provided, further, which has been impounded for being in violation this Chapter shall immediately have said dog 6-5-12: PERSON BITTEN BY DOG OR CAT: Whenever a dog or cat bites a person, the owner of said dog or cat shall at once notify the Rabies Inspector who shall have the dog or cat confined for a period of ten (10) days and observed by a licensed veterinarian. If at the end of this ten (10) day period the veterinarian is of the opinion that the dog or cat is free from rabies, he shall order the dog or cat released. All expenses incurred under this Section shall be paid by the owner of said dog or cat. 6-5-13: EXCEPTIONS: None of the provisions of this Chapter, excepting Sections 2, 3, 4 and 10 shall apply to the owners of seeing eye dogs. 6-5-14:' PENALTY: Any person who shall violate any of the pro- visions of this Chapter shall, upon conviction, be sub- ject to a fine of not less than twenty five dollars ($25.00) nor more than one hundred dollars ($100.00) for each offense. 2. That this Ordinance shall be in full force and effect 10 days after its passage by the City Council of the City of Canton, Illinois, approvel by the Mayor thereof, and publication according to law.
