HomeMy WebLinkAboutOrdinance #0849~. ~ ~ ~ ~ ~~ ORDINANCE N0, g ~l AN ORDINANCE AMENDING CERTAIN SECTIONS OF TITLE 6, CHAPTER 3 OF THE CANTON MUNICIPAL CODE CONCERNING MISDEMEANORS AND REPEALING CERTAIN SECTIONS OF TITLE 6, CHAPTER 3 OF THE CANTON MUNICIPAL CODE CONCERNING MISDEMEANORS. WHEREAS, the Legal & Ordinance Committee of the City of Canton, Illinois has determined that it is necessary, desirable and to the best interests of the City of Canton to modify and amend certain sections of Title 6, Chapter 3 of the Canton Municipal Code concerning misdemeanors and to repeal and delete certain sections of Title 6, Chapter 3 of the Canton Municipal Code concerning misdemeanors; and WHEREAS, the City Council of the City of Canton, Illinois has made a similar determination. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, ILLINOIS, AS FOLLOWS: 1. That Title 6, Chapter 3, Section 1-1 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 2. That Title 6, Chapter 3, Section 1-2 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 3. That Title 6, Chapter 3, Section 1-3 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 4. That Title 6, Chapter 3, Section 1-4 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 5. That Title 6, Chapter 3, Section 1-5 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 6. That Title 6, Chapter 3, Section 1-6 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal - 1 - { ~ .~ ~~ ~~ Code. 7. That Title 6, Chapter 3, Section 1-7 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 8. That Title 6, Chapter 3, Section 1-8 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 9. That Title 6, Chapter 3, Section 2-1 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 10. That Title 6, Chapter 3, Section 2-2 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 11. That Title 6, Chapter 3, Section 2-3 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 12. That Title 6, Chapter 3, Section 2-4 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 13. That Title 6, Chapter 3, Section 2-5 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 14. That Title 6, Chapter 3, Section 2-6 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 15. That Title 6, Chapter 3, Section 2-7 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 16. That Title 6, Chapter 3, Section 3-12 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. - 2 - 17. That Title 6, Chapter 3, Section 4-1 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 18. That Title 6, Chapter 3, Section 4-2 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 19. That Title 6, Chapter 3, Section 3 (A) and 3 (B) of the Canton Municipal Code be, and the same is hereby amended to read as follows: "6-3-4-3: TRESPASSING: (A) Trespassing Upon School Property: No person shall go upon, into, pass through or over any property or premises used for school purposes, within the City, under a penalty of not less than twenty five dollars ($25.00) nor more than five hundred dollars ($500.00); provided, that this subsection shall not be so construed as to apply to children while attending school, teachers, janitors, and such other persons as may go upon such property or premises for the transaction of any lawful business. (B) Trespassing on Public Parks: No person shall injure nor in any manner interfere with or disturb any tree, flower or shrub, or any other thing in any park, nor injure, cut, break or deface any seat, tree, lamps, shrub, flower or other thing in such park, under a penalty of not less than twenty five dollars (.$25.00) nor more than five hundred dollars (.$500.00)." 20. That Title 6, Chapter 3, Section 4-4 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 21. That Title 6, Chapter 3, Section 4-5 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 22. That Title 6, Chapter 3, Section 4-6 (A) of the Canton Municipal Code be, and the same is hereby amended to read as follows: "6-3-4-6: BILL POSTING: (A) Where Prohibited, Penalty: It shall be unlawful for any person to post, paste, print, paint, nail or otherwise fasten any handbill, sign, poster, advertisement or notice of any kind whatsoever (other than legal notices required to be posted - 3 - r by law, which may be posted upon telegraph, tele- phone or electric light poles with the consent of the owners thereof), or cause the same to be done, on any curbstone, flagstone, or any other portion or part of any sidewalk or street, or upon any tree, lamppost, hitching post, telegraph pole, telephone pole, electric light pole or pole used to support trolley wires or other electrical conductors, hydrant, bridge, public building, fountain or bandstand or other public structure, within the limits of the City; except such as may be required by the provisions of this Code; and no person shall paste, post, print, paint, nail or otherwise fasten any handbill, sign, poster, advertisement or notice of any kind, or cause the same to be done, upon any private wall, window, door, gate, fence, advertising board or sign, or on any other private structure or building, unless he is the owner, agent or lessee thereof, without the consent of the owner of such wall, window, door, gate, fence, advertising board or sign, or other private building or struc- ture. Any person violating any of the provisions of this subsection shall be fined not less than twenty five dollars ($25.00) nor more than five hundred dollars ($500.00) for each offense." 23. That Title 6, Chapter 3, Section 4-6 (B) of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 24. That Title 6, Chapter 3, Section 4-6 (C) of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Muni- cipal Code. 25. That Title 6, Chapter 3, Section 4-6 (D) of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Muni- cipal Code. 26. That Title 6, Chapter 3, Section 4-6 (E) of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Muni- cipal Code. 27. That Title 6, Chapter 3, Section 4-7 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 28. That Title 6, Chapter 3, Section 4-8 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. - 4 - 29. That Title 6, Chapter 3, Section 4-9 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 30. That Title 6, Chapter 3, Section 5-1 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 31. That Title 6, Chapter 3, Section 5-2 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 32. That Title 6, Chapter 3, Section 5-3 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 33. That Title 6, Chapter 3, Section 5-4 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 34. That Title 6, Chapter 3, Section 6-1 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 35. That Title 6, Chapter 3, Section 7-1 of the Canton Municipal Code be, and the same is hereby amended to read as follows: "6-3-7-1: CRUELTY TO ANIMALS: Whoever shall be guilty of cruelty to any animal in any of the ways mentioned in this Section shall be fined not less than twenty five dollars ($25.00) nor more than five hundred dollars ($500.00) for each offense, viz: (A) By overloading, overdriving, overworking, cruelly beating, torturing, tormenting, mutilating or cruelly killing any animal, or causing or know- ingly allowing the same to be done. (B) By cruelly working any old, maimed, infirm, sick, crippled or disabled animal, or causing or know- ingly allowing the same to be done. (C) By unnecessarily failing to provide any animal in his charge of custody, as owner or otherwise, with proper food, drink and shelter. (D) By abandoning any old, maimed, infirm, sick or disabled animal. - 5 - P (E) By carrying or driving, or causing to be carried or driven or kept, any animal in an unnecessarily cruel manner. (F) By inhumanly, unnecessarily or cruelly leaving tied out and exposed to the elements or without proper blanket or covering, or without food and drink, any animal, for an unreasonable length of time taking into consideration the hours of the day or night and the nature of the temperature and weather." 36. That Title 6, Chapter 3, Section 7-2 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 37. That Title 6, Chapter 3, Section 7-3 of the Canton Municipal Code be, and the same is hereby amended to read as follows: "6-3-7-3: KILLING BIRDS: It shall not be lawful for any person in the City, at any time, to kill or attempt to kill, or to trap or attempt to trap, net snare, harm or attempt to harm any robin, bluebird, swallow, martin, mosquito- hawk, whippoorwill, cuckoo, woodpecker, catbird, brown thrasher, yellow-hammer, redbird, finch, thrush, lark, yellowbird, oriole, bobolink, or any song bird, nor shall it be lawful to rob or destroy the nests of such birds, or of any or either of them; and any person convicted of a violation of the pro- visions of this Section shall forfeit and pay a fine of not less than twenty five dollars ($25.00) nor more than one hundred dollars ($100.00) for each offense." 38. That Title 6, Chapter 3, Section 7-4 of the Canton Municipal Code be, and the same is hereby amended to read as follows: "6-3-7-4: POISONOUS VINES: Whoever shall plant any poison ivy or other poisonous vine or plant within the City so near any public side- walk, street or alley as to injuriously affect passers- by, or whoever shall permit any such vine or plant to so grow in or upon any premises owned or controlled by him, shall be fined not less than twenty five dollars (_$25.00) nor more than one hundred dollars ($100.00) for each offense." 39. That Title 6, Chapter 3, Section 7-5 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 40. That Title 6, Chapter 3, Section 7-6 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. - 6 - w, ;, 41. That Title 6, Chapter 3, Section 7-7 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 42. That the remainder of Title 6, Chapter 3, Misdemeanors, of the Canton Municipal Code remain in full force and effect. 43. That this ordinance shall be in full force and effect upon its passage by the City Council of the City of Canton, Illinois and approval by the Mayor thereof.
