HomeMy WebLinkAboutOrdinance #0830~_ ORDINANCE N0. ~(} AN ORDINANCE AMENDING TITLE 5, CHAPTER 1, SECTION 2 (I), TITLE 5, CHAPTER 1, SECTION 4 (F), TITLE 5, CHAPTER 2, SECTION 6 AND TITLE 5, CHAPTER 3, SECTION 10 OF THE CANTON MUNICIPAL CODE CONCERNING THE FIRE DEPARTMENT AND REPEALING TITLE 5, CHAPTER 1, SECTION 4 (H) OF THE CANTON MUNICIPAL CODE CONCERNING THE FIRE DEPARTMENT. WHEREAS, the Legal & Ordinance Committee of the City of Canton, ,~ _ -% Illinois has determined that it is necessary, desirable and to the best interests of the City of Canton to modify and amend Title 5, Chapter 1, Section 2 (I), Title 5, Chapter 1, Section 4 (F), Title 5, Chapter 2, Section 6 and Title 5, Chapter 3, Section 10 of the Canton Municipal Code concerning the Fire Department and to repeal and delete Title 5, Chapter 1, Section 4 (H) of the Canton Municipal Code concerning the Fire Department; and WHEREAS, the City Council of the City of Canton, Illinois has made a similar determination. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, ILLINOIS, AS FOLLOWS: 1. That Title 5, Chapter 1, Section 2 (I) of the Canton Municipal Code be, and the same is hereby amended to read as follows: "5-1-2 (I): Bystanders to Obey Orders: Every person who shall be present at any fire shall be subject and obedient to the orders of the Chief of the Fire De- partment and the Assistant Chief of the Fire Department, in extinguishing the fire and the removal and protection of property, and in case any person shall refuse to obey such orders, he shall, upon conviction, be subject to a fine of not less than twenty-five dollars ($25.00), nor more than two hundred dollars ($200.00), for each offense; provided, that no person not a member of the Fire Department shall be bound to obey any of said officers, unless said officers shall bear their respective badges of office, or their official character shall be known to him, and said officers shall have the power to arrest any person or persons so refusing to obey such lawful orders as aforesaid." 2. That Title 5, Chapter 1, Section 4 (F) of the Canton Municipal Code be, and the same is hereby amended to read as follows: "5-1-4 (_F): Meetings: The Fire Department shall hold a meeting on the first Monday in each month. at the hour of six thirty o'clock (6:30) P.M., for the transaction of such business as may come before it. The members shall adopt such - 1 - . ~,_ . rules and order of business as they may deem necessary for the conduct of such meeting, not inconsistent with the provisions of this Section or any provision of this Code. All members, except the Chief of the Fire Depart- ment, present at any meeting shall be entitled to vote on any question, and a majority of those present shall decide; provided, that in case of a tie the Chief of the Fire Department shall cast the deciding vote. A majority of the members shall constitute a quorum to do business, but a smaller number may adjourn from time to time." 3. That Title 5, Chapter 2, Section 6 of the Canton Municipal Code be, and the same is hereby amended to read as follows: "5-2-6: Impersonating Firemen: No person not a member of the Fire Department, shall impersonate a fireman or officer of the Fire Department, under a penalty of not less than twenty-five dollars ($25.00) nor more than two hundred dollars ($200.00) for each offense." 4. That Title 5, Chapter 3, Section 10 of the Canton Municipal Code be, and the same is hereby amended to read as follows: "5-3-10: Pay for Services Rendered: Each Volunteer Fireman shall receive the following pay for services rendered to this City as such. (A) For each regular training period (or, day) attended, the sum of six dollars ($6.00) (but not to exceed twelve dollars ($12.00) per month). (B) For each fire call attended, the sum of four dollars ($4.00). (C) For each standby call (involving a continuous period of twenty four (24) hours) the sum of four dollars ($4.00) per hour. The Fire Chief shall be personally responsible for certifying pay entitlements of Volunteer Firemen on a monthly basis to the appropriate officials of this City, the same to be in his monthly report. Payment for services rendered shall be made to each Volunteer Fireman as soon after the first Council meeting of each month as may be practi- cable." 5. That Title 5, Chapter 1, Section 4 (H) of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 6. That the remainder of Title 5, Fire, of the Canton Municipal Code remain in full force and effect. 7. That this Ordinance shall be in full force and effect 10 days after its passage by the City Council of the City of Canton, Illinois, approval by the Mayor thereof, and publication according to law. - 2 - r ~.
