HomeMy WebLinkAboutOrdinance #0875f ~ .I ~ V' ORDINANCE N0 . ~ ~ _ j AN ORDINANCE AMENDING CERTAIN SECTIONS OF TITLE 8, CHAPTER 6 OF THE CANTON MUNICIPAL CODE CONCERNING GRADES. WHEREAS, the Legal and Ordinance Committee of the City of Canton, Illinois has determined that it is necessary, desirable and to the best interests of the City of Canton to modify and amend certain sections of Title 8, Chapter 6 of the Canton Municipal Code concerning grades; and WHEREAS, the City Council of the City of Canton, Illinois has made a similar determination. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, ILLINOIS, AS FOLLOWS: 1. That Title 8, Chapter 6, Section 1 of the Canton Municipal Code be, and the same is hereby amended to read as follows: "8-6-1: DATUM PLANE ESTABLISHED: There is hereby established a base or datum plane of reference to which all City levels, and all permanent grade points, hereinafter established, shall refer. Said base or datum plane shall be taken as a reference plane, and is hereby established at one hundred feet (100') below the top of a bronze pin set in a con- crete post in the southwest quarter of Jones Park in the Public Square in the City, and being approximately at a point forty four feet (44') east of the outer face of the curb on the west side of said Jones Park, and two hundred four and seven-tenths feet (204.7') north of the outer face of the curb on the south end of Jones Park. The permanent grades of all streets and alleys in the City, hereinafter fixed, shall refer to said base or datum plane. The U.S. Geological Survey elevation is equal to 562.6 feet plus the City Data." 2. That Title 8, Chapter 6, Section 3 of the Canton Municipal Code be, and the same is hereby amended to read as follows: "8-6-3: NEW SIDEWALKS TO CONFORM: All new sidewalks, and sidewalks that may be rebuilt, shall be built on and made to conform to the grade which shall be established by the City Engineer, and a record of the sidewalk grade when established, shall be kept in a book provided for that purpose, and permanent stone landmarks set below the frost line to keep the grade line as established in a condition to be ascertained for the purpose of public improvements in the City. Any person violating any of the provisions of this Section shall be subject to a penalty of not less than twenty five dollars ($25.00) nor more than five hundred dollars ($500.00) for each and every offense." 3. That the remainder of Title 8, Chapter 6, Grades, of the Canton Municipal Code remain in full force and effect. 4. That this Ordinance shall be in full force and effect upon its passage by the City Council of the City of Canton, Illinois and approval by the Mayor thereof.
