ORDINANCE NO.~ AN ORDINANCE AMENDING TITLE 8, CHAPTER 10, SECTION 8 OF THE CANTON MUNICIPAL CODE CONCERNING THE DEPOSIT REQUIRED FOR WATER AND REPEALING TITLE 8, CHAPTER 10, SECTION 27 OF THE CANTON MUNICIPAL CODE CONCERNING THE PROPERTY OWNERS' RESPONSIBILITY FOR WATER RENTS. WHEREAS, the Legal and Ordinance Committee of the City of Canton, Illinois has determined that it is necessary, desirable and to the best interests of the City of Canton to modify and amend Title 8, Chapter 10, Section 8 of the Canton Municipal Code concerning the deposit required for water and to repeal and delete Title 8, Chapter 10, Section 27 of the Canton Municipal Code concerning the property owners' responsibility for water rents; and WHEREAS, the City Council of the City of Canton, Illinois has made a similar determination. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, ILLINOIS, AS FOLLOWS: 1. That Title 8, Chapter 10, Section 8 of the Canton Municipal Code be, and the same is hereby amended to read as follows: "8-10-8: DEPOSIT REQUIRED: No water shall be turned on for use on or in any premises until an application therefor in writing has been made for that purpose and filed with the Cashier of the City Water Department, stating the purpose for which the water is to be used. If the applicant is not the owner in fee simple of the recorded title to the property where the applicant desires the water to be turned on, he shall deposit with his application the sum of fifty dollars ($50.00) before any water is turned on. Such deposit shall be held by the City as security for the payment of water used by the applicant and may be so applied when any default is made in payment of a water bill. Any person who shall occupy business property as a tenant and shall consume water furnished by the City, shall, before entering said property, make a deposit of one hundred dollars ($100.00) with the Cashier of the City Water Department. This deposit shall be kept in a separate fund and shall be returned to said person when said premises are vacated by said person, provided there is no money due the City for water, in which case the amount owing the City shall first be deducted and the balance remaining returned to the person making said deposit." ,, r f + • s 2. That Title 8, Chapter 10, Section 27 of the Canton Municipal Code be, and the same is hereby repealed and deleted from the Canton Municipal Code. 3. That the remainder of Title 8, Chapter 10, Water and Sewer System Rates, of the Canton Municipal Code remain in full force and effect. 4. That this Ordinance shall be in full force and effect upon its passage by the City Council of the City of Canton, Illinois and approval by the Mayor thereof.
