HomeMy WebLinkAboutOrdinance #0896 '. , ,»- r a 1 ORDINANCE NO. ~qlp Rezoning certain property of the relational Bank of Canton, Land Trustee f_or a Planned Unit Development in the City of_ Canton, Illinois. WHEREAS, it appears to the City Council of the City of Canton, Illinois that the territory hereinafter described is located within the corporate limits of_ the City of Canton, said premises being generally located on the West side of North Avenue F in the City of Canton, Fulton County, Illinois and WHEREAS, it further appears to-said City Council that a Petition for a Planned Unit Development was duly filed and proper notice thereof_ was published in the Canton Daily Ledger, a secular newspaper having a general circulation in the city of Canton, County of Fulton and State of Illinois, said notice having been made and published according to the Statutes of the State of Illinois and the Ordinances of the City of Canton, Illinois, and WHEREAS, a public hearing was held before the Planning and Zoning Commission of the City of Canton, Illinois and thereafter two additional meetings of the Planning and Zoning Commission of the City of Canton, Illinois were had to consider the Planned Unit Development sought by the Developer, H. E. Snow, and WHEREAS, it further appearing to said City Council that the Planning and Zoning Commission of the City of. Canton has had input from the City of Canton Community Development Department Staff and the City Attorney and has thoroughly considered the Planned Unit Development sought herein, and WHEREAS, it further appearing to said City Council that on Auqust 19, 1981 at a special meeting of the Planning and -1- . ~ ;~ ~. Zoning Commission that the Planning and Zoning Commission of the City of Canton made the following findings in accordance with 10-13-3(A) of the City Code of_ the City o.f Canton: A. That the proposed use as a residential use which ~i,is permitted in the area sought by the Planned Unit Development; B. That the proposed Planned Unit Development is com- patable with development allowed under the basic provisions o.f. the Zoning Ordinance and is not of such a nature in height, bulk or scale so as to exercise any influence contrary to the purposes of the intent of the Zoning Ordinance; C. That the proposed uses and development plan are compatable with and implement the goals and objectives of the City as contained in the comprehensive general plan or other pertinent policy resolutions; D. That the proposed Planned Unit Development can be completed within two years of the granting permit and that it is envisioned that the completion will be made by June 1982; E. That there are no streets proposed inside the Planned Unit Development and that existing streets are suit- able and adequate to carry anticipated traffic without over- loading and public adjacent street; F. That the developer proposes to install a four inch sewer line and four inch water line .from Westwood Estates, Section 1 and that such utility services are adequate for the proposed Planned Unit Development; G. That the applicant has adequate financial resourses to assure the completion of the Planned Unit Development, subject however to the preparation of. a Performance Bond with adequate surety in such form as the City Attorney and the Community Development Director shall deem appropriate for the protection of -the City's interest in the development -2- 1~ of said Planned Unit Development, and WHEREAS, on August 19, 1981 the Planning and Zoning Commission of the City of Canton unanimously recommended the Planned Unit Development proposed by the developer, said development plan being primarily f.or a residential use for three families; THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, ILLINOIS: Section 1. That the Territory hereinafter described be and the same as hereby designated as a Planned Unit Develop- ment constituting a residential use for three families all as !more fully set out in the Planned Unit Development Documents on file by the developer, said premises being more particularly described as follows: A part of the NE 1/4 of Sec. 28, T. 7N, R. 4 E. of the 4th P.M., more particularly described as follows: Commencing at the intersection of the West Right-of-Way line of North Ave. F with the South line of the NF' 1/4 o.f said Sec. 28 as the Point of Beginning of the tract to be described; thence N 4°-51'-13" W along the West Right-of-Way line of North Ave. F, a distance of 3?..52 feet; thence N 0°-51-28" E along the West Right-of-Way line of North Ave. F, a distance o.f 532 feet; thence S 86°-20'-11" W. a distance of 369.36 feet to the most Southerly corner of Outlot A in Westwood Estates, Section One, a sub- division of part of the NE 1/4 of said Sec. 28; thence S 3°-13'-02" E, a distance of 541.63 feet to a point on the South line of the NE 1/4 of said Sec. 28; thence in 89°-59'-40" E along the South line of the NE 1/4 of said Sec. 28, a distance of 333 feet to the Point of Beginning, containing 4.434 Acres, situate, lying and being in the County of Fulton and State of Illinois. Section 2. That the City of Canton zoning maps, documents and related regulations be and the same are hereby amended so that the territory hereinabove described shall be, and the same is hereby zoned in conformance with the Planned -3- Unit Development Documents now on file. Section 3. That an adequate Performance Bond with adequate sureties be prepared and filed with the City. Such Performance Bond and sureties shall be in such form and such amount as the City Attorney and Community Development Director deem necessary for the protection o.f the City's interest in the development of said PUD. Section 4. That, in the event the developer should choose to utilize a Land Trust for the holding of legal title to the property described in Section 1, then and in .that event the developer, his successors and assigns shall I place on file with the City of. Canton the names and address of the owners of 1000 of the beneficial interest in such land trust and further that there shall be filed with the City of Canton written notice of all changes of the ownership of the beneficial interest in said premises as the same may occur from time to time. Such written notice shall be filed with the City Clerk of the City of Canton, Illinois. Section 5. That all surface drainage water be directed toward Big Creek as the same flows in the ordinary course of nature. Section 6. That the developer subsequently designate any nature areas or conservation areas which will not be dis- turbed by subsequent development.
