Short Property ORDINANCE NO. 941 AN ORDINANCE DIRECTING THE ACQUISITION BY CONDEMNATION OF CERTAIN REAL PROPERTY HEREINAFTER BEING MORE PARTICULARILY DESCRIBED r WHEREAS, the City Council of the City of Canton, Fulton County, Illinois has heretofore adopted Resolution #955 which, inter alia, directed the acquisition of real property therein described; and, WHEREAS, diligent allempts to reach an agreed upon price for the sale and purchase of such real property have been unsuccessful. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. It is hereby determined and redetermined that it is necessary, appropriate and desirable that the City of Canton acquire fee simple title to and possession of the following described real property, which such property is determined and redetermined to be necessary, required and needed for public purposes in the rehabilitation and/or redevelop- ment of the Southeast Neighborhood Strategic Area, a "Conservation Area," to-wit: Lot Number Three (3) and the North Eight (8) feet of Lot Number Four (4) in Block 6 in Anderson's First Addition to the City of Canton, Fulton County, Illinois. Common Address: 225 South Fifth Avenue Canton, Illinois 2. That the above described real property lies wholly within the corporate limits of the City of Canton, Fulton County, Illinois, and within the boundary of the Southeast Neighborhood Strategic Area. 3. That the City of Canton, through James H. Malmgren, its City Attorney, acquire the fee simple title to and possession of the above described real property by condemnation. And, that the aforesaid City Attorney is hereby authorized, empowered and instructed to institute proceedings in a court of competent jurisdiction to acquire fee simply title to and possession of the above described real property,in accordance with the eminent domain laws of the State of Illinois. 4. That this Ordinance shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois, and approval by the Mayor thereof. PASSED by the City Council of the City of Canton, Fulton County, Illinois this 7th day of September 1982, at a regular meeting and upon a roll call vote as follows: AYES: Aldermen Horr, Larsen, Carl, Grant, Sarff, Savill, Hammond, Kovachevich.
