HomeMy WebLinkAboutResolution #5306 RESOLUTION NO. 5306 FOR THE,CITY OF CANTON WHEREAS,the City of Canton,Fulton County, Illinois ("City"), is a non-home rule unit of government. WHEREAS, 65 ILCS 5/8-2-9.1 provides, "Every municipality with a population of less than 500,000 (except special charter municipalities having a population in excess of 50,000) that has adopted this Section 8-2-9.1 and Sections 8-2-9.2 through 8-2-9.10 by a two-thirds majority vote of those members of the corporate authorities then holding office shall have a budget officer who shall be designated by the mayor or president, with the approval of the corporate authorities. In municipalities operating under the commission form of government, the commissioner of accounts and finances shall designate the budget officer,with the approval of the council or board of trustees, as the case may be. In municipalities with a managerial form of government, the municipal manager shall designate the budget officer. The budget officer shall take an oath and post a bond as provided in Section 3.1-10-25. The budget officer may hold another municipal office, either elected or appointed (including, but not limited to, the office of mayor or president in municipalities with a population under 10,000), and may receive compensation for both offices except when a mayor or president in a municipality with a population under 10,000 is also the budget officer.Article 10 of this Code shall not apply to an individual serving as the budget officer. The budget officer shall serve at the pleasure of the mayor or municipal manager, as the case may be." WHEREAS, Section 1-25-1 of the Canton Municipal Code provides, "There is hereby created an office of budget director. The budget director shall be appointed by the mayor with the advice and consent of the city council. The budget director shall be chosen on the basis of executive, administrative, and educational qualifications with special emphasis on the actual experience in, or knowledge of, accepted practice with respect to the office hereinafter set forth." WHEREAS, the Mayor has appointed CliftonLarsonAllen LLP to serve as Budget Director, as defined by the City of Canton Municipal Code, and Budget Officer, as defined by Section 8-2-9.1 of the Illinois Municipal Code. WHEREAS, the corporate authorities of the City of Canton finds it to be in the best interests of the City to approve CliftonLarsonAllen LLP to serve as Budget Director / Budget Officer for the City of Canton. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF CANTON, FULTON COUNTY, ILLINOIS AS FOLLOWS: 1. The City of Canton hereby fmds as fact the recitals set forth above and are incorporated herein as though fully set forth; 2. CliftonLarsonAllen LLP is hereby appointed Budget Director/Budget Officer(hereinafter the "Budget Officer") of the City of Canton pursuant to the Illinois Municipal Code and City of C. tnn Mpniripal Code; 3. The Budget Officer shall take an oath and post a bond as provided in 65 ILCS 5/3.1-10-25 65 ILCS 5/3.1-10-30; 4. The amount of the bond shall be at least an amount of money equal to the amount of bond for the City Treasurer; however, in not event shall the amount of the bond be less than 3 times the latest Federal census population or any subsequent census figure used for Motor Fuel Tax purposes. 5. All compensation for the Budget Officer shall be made payable to CliftonLarsonAllen LLP pursuant to an agreement and/or letter of engagement with said firm, which includes the providing of Budget Officer / Budget Director duties therein. The Budget Officer being appointed hereunder is an independent contractor and is not an employee of the City of Canton. The Mayor is authorized to executed any and all agreements or letters of engagement regarding the said compensation. 6. Upon approval of this Resolution by the City Council, the Bond may be finalized and approved by the Mayor and the City Clerk. 7. That this Resolution shall be in full force and effect immediately upon its passage by the City Council of the City of Canton,Illinois and approval by the Mayor thereof.
