ORDINANCE N0. 913 AN ORDINANCE AMENDING SECTION 4 OF CHAPTER 2 OF TITLE 3 OF THE CANTON MUNICIPAL CODE BY DELETIPIG ALL REFERENCE TO PAWNBROKERS AND ADDING SECTION 5 OF CHAPTER 2 OF TITLE 3 OF THE CANTON MUNICIPAL CODE LICENSING AND REGULATING PAWNBROKERS; SWAP SHOP PROPRIETORS; DEALERS IN COINS, PRECIOUS OR SEMI-PRECIOUS METALS OR JEWELS; AND, OTHER SIMILAR BUSINESSES. WHEREAS, the Legal and Ordinance Committee has determined that it is in the best interest of the City of Canton to license and regulate all persons engaging in business within said municipality as pawnbrokers; swap shop proprietors; dealers in second hand goods; dealers in coins, precious or semi-precious metals or jewels; and other businesses of similar nature; and, WHEREAS, the City Council of the City of Canton, Fulton County, Illinois, has made a similar determination. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. That Section 4 of Chapter 2 of Title 3 of the Canton Municipal Code is hereby amended by deleting therefrom all reference to the licensing of pawnbrokers. 2. That Section 5 is hereby added to Chapter 2 of Title 3 of the Canton Municipal Code, to read as follows: 3-2-5 PAWNBROKERS; SWAP SHOPS; DEALERS IN SECOND HAND GOODS; DEALERS IN COINS, PRECIOUS OR SEMI-PRECIOUS METALS OR JEWELS. (A) License Required; All persons desiring to engage in business within the corporate limits of the City of Canton as pawnbrokers; swap shop proprietors or operators; dealers in second hand goods; dealers in coins, precious or semi-precious metals or jewels; and, all other businesses of a similar nature, shall first obtain a license therefor, under penalty of not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00) for each offense. }, .. .. ~ (C) License Fee: $15.00 per year, non-refundable and payable in advance. (D) Keeping Records Required: All persons holding licenses under this section shall keep a permanently bound book in which shall be written in ink, at the time of each and every transaction, loan or pledge, an accurate account and description, in the English language, of all the goods, articles and other things pawned, pledged or which were the subject of any transaction; the amount of money, value or thing loaned thereon, pledged thereon or traded or exchanged therefor; the time of pledging, loaning, trading or exchanging; and, the name and residence address of the person making such loan, pledge, trade or exchange. No entry in such book shall be erased, mutilated or changed. (E) Inspection: The said book, as well as every article or other thing so pawned, pledged, traded or exchanged, shall at all times be open to the inspection of the Sheriff of Fulton County, Illinois, or, any of his deputies, and to the Chief of Police of the City of Canton, Fulton County, Illinois, or, to any officer or investigator under his command. (F) Property from Minor: No person licensed under this Section shall pawn, pledge, trade or exchange any article or item with a minor without first obtaining written permission from such minor's parent or guardian. Proof of receipt of such written permission shall be kept for one calendar year following such transaction and shall be made available for inspection as provided in subparagraph (E), above. (G) Revocation of License: Any person holding a license under this section who violates any of the provisions hereof shall have his license suspended or revoked by the riayor as follows: (1) First offense or violation: Suspension of license of not less than thirty (30) days nor more than one hundred twenty (120) days, as determined by the Mayor. (2) Second or subsequent offense or violation: Revocation of license ,~ ~, , . ~ ($25.00) nor more than five hundred dollars ($500.00). (I) Application Period for Existing Businesses: Any person owning or operating any of the foregoing businesses on the effective date hereof shall, within thirty (30) days of such effective date, make application for the license required of this section. During such thirty day period, all such businesses already in existence shall be permitted to continue to operate, pending application for and issuance of the required license. 3. This ordinance shall be in full force and effect immediately upon its passage by the City Council, approval by the rlayor and publication according to law. Chestnut Street, Canton, Illinois , commencing on January 6th 19 82 and continuing for at least ten (10) days thereafter.- Copies of such Ordinance were also available for public inspection upon request in the Office of the City Clerk.
