HomeMy WebLinkAboutOrdinance #0986..~ .~ . _;- ORDINANCE NO. 986 AN ORDINANCE AMENDING CHAPTER 1, TITLE 5 OF THE CANTON MUNICIPAL CODE, RE-STRUCTURING THE CITY OF CANTON FIRE DEPARTMENT AND RE- ESTABLISHING THE CITY OF CANTON FIRE DEPARTMENT'S AUTHORIZED STRENGTH WHEREAS, the Committee on Negotiation, Grievance and Personnel has determined that it is necessary and in the best interest of the City of Canton to restructure the City of Canton Fire Department and to re-establish such Department's authorized strength; and, WHEREAS, the Canton City Council has made a similar determination. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. That subparagraph (A) of Section 1, Title 5 of the Canton Municipal Code is amended to read as follows: "5-1-1 (A): FIRE DEPARTMENT ESTABLISHED: There is hereby establis- hed an executive department of the Municipal govern- ment of the City which shall be known as the Fire Department, and shall consist of one Chief of the Fire Department, three (3) Assistant Chiefs, five (5) Lieutenants, and seven (7) Firemen." 2. That, in making the foregoing change, the Canton City Council specifically recognizes the desireability of having a clearly delineated chain-df-command within the Department; to that end, the Canton City Council hereby specifically finds that three (3) lieutenants in the Department are desireable (but not absolutely necessary). Because of past practices the Canton City Council hereby specifically finds that replacement of only three of five previous lieutenant positions would be detrimental to the Department. That, accordingly, it is hereby determined by the Canton City Council that the lieutenant positions (or, any other similar positions) shall be reduced through attrition from the present level of five lieutenants to three lieutenants. 3. That nothing contained in this Ordinance shall be construed to prevent the Canton City Council from reducing or eliminating the size of, composition of, or existence of said Department; nor, shall anything herein be construed as giving any person a vested interest in, possessory interest in, or any claim to retention of title or position in the event of future force reduction or realignment of said Department. 4. That re-instatement of persons formerly having been lieutenants in said Department to such rank shall be in conformity with the re- quirements of the Illinois Revised Statutes (1981), Chapter 24, ~ 10-2.1-1 et sequi. Computation of time-in-grade shall be computed by reference to said statute and to the Rules of the City of Canton Fire and Police Commission; likewise, date-of-rank for pay purposes shall be computed by reference thereto. v ~ ~ 1 5. That this Ordinance shall become effective immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois and approval by the Mayor thereof. PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular meeting this 2nd day of August , 1983, upon a roll call vote as follows: AYES• Aldermen Horr, May, Carl, Workman, Sarff, Savill, Hammond, Kovachevich.
