ORDINANCE N0. 962
AN ORDINANCE ANNEXING AND RE-ZONING CERTAIN TERRITORY TO THE CITY OF CANTON,
FULTON COUNTY, ILLINOIS.
WHEREAS, a Petition for Annexation and Re-Zoning, signed by the owners
of record, contract sellers and contract purchaser of all the land within
the territory hereinafter described, was filed before the Planning and Zoning
Commission of the City of Canton, Illinois, requesting that said territory
be annexed to the City of .Canton and re-zoned; and
WHEREAS, the real estate which is the subject matter of this Petition
is legally described in Exhibit A, which is attached hereto and made a part
of this Ordinance by reference, and is located at 1675 East Walnut Street,
Canton, Illinois; and
WHEREAS, Robert Wheeler, Jr., Irene U. Wheeler and Robert Wheeler, III
are the owners of record and contract sellers and Ronald L. Wheeler is the
contract purchaser of the real estate to be annexed and re-zoned and there
are no other owners of record; and
WHEREAS, the real estate to be annexed and re-zoned is not within
the corporate limits of any municipality, but is contiguous to the City
of Canton, Illinois; and
WHEREAS, there are no electors residing in the territory to be annexed
and re-zoned; and
WHEREAS, the real estate to be annexed and re-zoned is part of the
Canton Community Fire Protection District, but is not a part of any Public
Library District; and
WHEREAS, proper notice of the filing of the Petition for Annexation
and Re-Zoning has been given to the Trustees of the Canton Community Fire
Protection District as provided by law and an affidavit that service of
notice has been made as provided by law has been filed with the Fulton
County Recorder of Deeds; and
WHEREAS, all petitions, documents and other necessary legal
requirements are in full compliance with the statutes of the State of
Illinois; and
WHEREAS, a public hearing was held before the Planning and Zoning
Commission of the City of Canton, Illinois on December 13, 1982, pursuant
to proper notice published in the Canton Daily Ledger; and

WHEREAS, on January 10, 1983, the Planning and Zoning Commission of
the City of Canton, Illinois recommended to the City Council of the City of
Canton, Illinois that the real estate described in Exhibit A be annexed to
the City of Canton, Illinois in an I-1 (Light Industrial District) Zoning
Classification, pursuant to the provisions of Chapter 24, Section 7-1-8
of the Illinois Municipal Code; and
WHEREAS, the real estate to be annexed and re-zoned has been used for
many years as a truck repair shop, is well suited for that purpose and
should be annexed to the City of Canton in an I-1 (Light Industrial District)
Zoning Classification; and
WHEREAS, the highest and best use of the real estate to be annexed
and re-zoned is its present use; and
WHEREAS, it is in the best interests of the City of Canton, Illinois
that said territory be annexed to the City of Canton, Illinois in an I-1
(Light Industrial District) Zoning Classification.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CANTON, ILLINOIS, AS FOLLOWS:
1. That the City Council finds as facts the recitals hereinabove
set forth.
2. That the territory described in Exhibit A, which is attached
hereto and made a part of this Ordinance by reference, be and the same is
hereby annexed to the City of Canton, Illinois.
3. That this property shall be annexed in an I-1 (Light Industrial
District) Zoning Classification.
4. That the Zoning Administrator of the City of Canton, Illinois is
hereby directed to make the appropriate changes to the zoning maps of the
City of Canton to reflect this annexation and re-zoning.
5. That the City Clerk of the City of Canton, Illinois is hereby
directed to record with the Recorder of Deeds of Fulton County and to file
with the County Clerk of Fulton County a certified copy of this Ordinance,
together with an accurate map of the annexed territory.
6. That this Ordinance shall be in full force and effect upon its
passage by the City Council of the City of Canton, Illinois and approval by
the Mayor thereof.

TRACT I
The North 426.18 feet off the North end of a 51.689
foot strip of land; being the West 51.689 feet of the
following described real estate, to-wit:
Part of the Southwest Quarter of the Southwest Quarter
of Section 25, in Township 7 North, Range 4 East of
the Fourth Principal Meridian, Canton Township, Fulton
County, Illinois, described as follows: Beginning at
a point 522.06 feet East of the Southwest corner of the
Southwest Quarter of the Southwest Quarter of Section
25, Township 7 North, Range 4 East of the Fourth
Principal Meridian, thence North 626.18 feet, thence
West 262.02 feet, thence South 626.18 feet, thence
East 262.02 feet along the Section Line to the point
of beginning, containing 3.766 acres more or less,
situated in the County of Fulton and State of Illinois.
TRACT II
Part of the Southwest Quarter of the Southwest Quarter of
Section 25, in Township 7 North, Range 4 East of the Fourth
Principal Meridian, Canton Township, Fulton County, Illinois
described as follows: Beginning at a point 522.06 feet
East of the Southwest corner of the Southwest Quarter of
the Southwest Quarter of said Section 25, thence North
626.18 feet, thence West 262.02 feet, thence South 626.18
feet, thence East 262.02 feet along the Section line to
the place of beginning, containing 3.766 acres; excepting
therefrom 69.56 feet off the East side thereof and
excepting therefrom 51.689 feet off the West side thereof,
situated in the County of Fulton and State of Illinois.
