ORDINANCE N0. 1037
AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR THE OPERATION OF
A DRIVE-UP CARRY OUT FOOD SERVICE AT ADDRESS OF 359 EAST LOCUST
STREET,
WHEREAS, it appears to the City Council of the City of Canton,
Fulton County, Illinois that the territory hereinafter described
is located within the corporate address of 359 East Locust Street;
and ,
WHEREAS, a petition for a special use home occupation was duly
filed by the Petitioners and due and proper notice thereof was
published within said City and County, all in accordance with the
Statutes of the State of Illinois and the Ordinances of the City
of Canton; and,
WHEREAS, a public hearing concerning such petition was held
before the Planning and Zoning Commission of the City of Canton,
Illinois on August 13, 1984 pursuant to notice; and,
WHEREAS, no objectors appeared at said hearing and said
Commission did thereupon recommend to the Canton City Council that
said special use permit for the operation of a sirive-up carry out
food service by Sam and Bertha Ladd at address of 359 East Locust
Street be allowed,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CANTON, Fulton County, Illinois i.s as follows:
1. That the City Council of the City of Canton, Fulton County,
Illinois hereby finds the foregoing recitals to be fact.
2. That a special use permit for the operation of a drive-up
carry out food service be issue to, and the same hereby is issued
to, Sam and Bertha Ladd at address of 359 East Locust Street, Canton,
Illinois affecting real property being legally described as follows,
to -wit
Lot Number 5 in Block Number 5 of Gould's Addition to the
City of Canton, except roads and highways,
3. That this special use permit is personal to Sam and Bertha
Ladd at the above stated address only. That any cessation of such
use by Sam and Bertha Ladd or their moving or removal from said
address shall automatically terminate said special use permit. That,
further, such special use permit is not transferrable or valid at
any other address or affecting any other property.
4, That the records of the City of Canton, appropriate docu-
ments, maps and related regulations be, and the same hereby are,
amended to reflect the foregoing special use permit.

PASSED by the City Council of the City of Canton, Fulton
County, Illinois at a regular meeting this 18th day of September ,
1984 upon a roll call vote as follows:
AYES: Aldermen H~mnnd, Savill, Sarff, Wor~nan, Carl, May, Horr.
NAYS : None
ABSENT : Alderman Kovachevich.
